AN ACT to amend the family court act, in relation to establishing time
limitations for proceedings involving custody or visitation
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. The family court act is amended by adding a new section 658
2 to read as follows:
3 S 658. TIME LIMITATIONS FOR PROCEEDINGS INVOLVING CUSTODY OR VISITA-
4 TION. IN ANY PROCEEDING BROUGHT PURSUANT TO SECTIONS FOUR HUNDRED
5 SIXTY-SEVEN, SIX HUNDRED FIFTY-ONE, OR SIX HUNDRED FIFTY-TWO OF THIS ACT
6 TO DETERMINE TEMPORARY OR PERMANENT CUSTODY OR VISITATION, ONCE A HEAR-
7 ING OR TRIAL IS COMMENCED, IT SHALL PROCEED TO CONCLUSION WITHIN NINETY
8 DAYS. THE PENALTY FOR FAILING TO PROCEED TO CONCLUSION WITHIN NINETY
9 DAYS SHALL BE DISMISSAL OF THE PETITION AND ANY INTERIM ORDER SHALL BE
10 DEEMED VOID AND UNENFORCEABLE.
11 S 2. This act shall take effect immediately.
