       AN ACT to amend the  penal  law,  in  relation  to  licenses  to  carry,
         possess, repair and dispose of firearms issued to military veterans
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (f) of  subdivision  1  and  subdivision  4-b  of
    2  section  400.00  of  the  penal  law,  paragraph (f) of subdivision 1 as
    3  amended by chapter 189 of the laws of 2000 and subdivision 4-b as  added
    4  by chapter 446 of the laws of 1997, are amended to read as follows:
    5    (f)  in  [the]  ANY  county  [of  Westchester,  who  has  successfully
    6  completed] WHICH REQUIRES SUCCESSFUL COMPLETION  OF  a  firearms  safety
    7  course  and  test  as evidenced by a certificate of completion issued in
    8  [his or her] THE APPLICANT'S name and endorsed and  affirmed  under  the
    9  penalties of perjury by a duly authorized instructor, [except that: (i)]
   10  persons  who are honorably discharged from the United States army, navy,
   11  marine corps or coast guard, or [of] FROM  the  national  guard  of  the
   12  state  of  New  York, WITHIN EIGHT YEARS PRIOR TO APPLYING FOR A LICENSE
   13  and produce evidence of official qualification in  firearms  during  the
   14  term  of  service  are  not  required to have completed those hours of a
   15  firearms safety course pertaining to the safe use, carrying, possession,
   16  maintenance and storage of a firearm[;]  and  [(ii)]  persons  who  were
   17  licensed  to possess a pistol or revolver prior to the effective date of
   18  this paragraph are not required to  have  completed  a  firearms  safety
   19  course and test; and
   20    4-b.  Westchester  county  firearms  safety course certificate. In the
   21  county of Westchester, at the time of application, the licensing officer
   22  to which the license application is made shall provide  a  copy  of  the
   23  safety  course booklet to each license applicant. Before such license is
   24  issued, such licensing officer shall require that the applicant submit a
   25  certificate of successful completion of a  firearms  safety  course  and

    1  test  issued  in  his  or  her  name and endorsed and affirmed under the
    2  penalties of perjury by a duly authorized instructor UNLESS  THE  APPLI-
    3  CANT  HAS  BEEN HONORABLY DISCHARGED FROM THE UNITED STATES NAVY, MARINE
    4  CORPS  OR  COAST  GUARD,  OR FROM THE NATIONAL GUARD OF THE STATE OF NEW
    5  YORK, WITHIN EIGHT YEARS PRIOR TO APPLYING FOR A LICENSE AND CAN PRODUCE
    6  EVIDENCE OF OFFICIAL  QUALIFICATION  IN  FIREARMS  DURING  THE  TERM  OF
    7  SERVICE.
    8    S 2. This act shall take effect immediately.
