       AN ACT to amend the agriculture and markets law, in relation to creating
         a horizontal silo leachate runoff working group
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. The agriculture and markets law is amended by adding a new
    2  article 13-F to read as follows:
    3                                ARTICLE 13-F
    4                HORIZONTAL SILO LEACHATE RUNOFF WORKING GROUP
    5  SECTION 160-W. HORIZONTAL SILO LEACHATE RUNOFF WORKING GROUP.
    6    S 160-W. HORIZONTAL SILO LEACHATE RUNOFF WORKING GROUP. 1. THE COMMIS-
    7  SIONER SHALL ESTABLISH A WORKING GROUP TO  STUDY  THE  OPTIONS  FOR  THE
    8  TREATMENT  AND  MANAGEMENT  OF LEACHATE RUNOFF FROM HORIZONTAL OR BUNKER
    9  SILOS.
   10    2. THE WORKING GROUP SHALL INCLUDE: REPRESENTATIVES FROM  THE  DEPART-
   11  MENT  OF AGRICULTURE AND MARKETS, REPRESENTATIVES FROM THE DEPARTMENT OF
   12  ENVIRONMENTAL CONSERVATION, REPRESENTATIVES FROM EMPIRE  STATE  DEVELOP-
   13  MENT,  REPRESENTATIVES  FROM  THE  NEW YORK STATE FARM BUREAU, REPRESEN-
   14  TATIVES  FROM  THE  UNITED  STATES  DEPARTMENT  OF  AGRICULTURE  NATURAL
   15  RESOURCE  CONSERVATION SERVICE, REPRESENTATIVES FROM THE NORTHEAST DAIRY
   16  PRODUCERS ASSOCIATION AND REPRESENTATIVES FROM  THE  APPROPRIATE  INSTI-
   17  TUTIONS AT CORNELL UNIVERSITY.
   18    3.  THE  WORKING GROUP SHALL MEET REGULARLY AND SHALL REVIEW AND STUDY
   19  THE OPTIONS AND BEST PRACTICES THAT ARE AVAILABLE, INCLUDING THOSE  FROM
   20  OTHER  STATES,  FOR THE TREATMENT AND MANAGEMENT OF LEACHATE RUNOFF FROM
   21  HORIZONTAL OR BUNKER SILOS. THE WORKING GROUP  SHALL  INCLUDE  IN  THEIR
   22  DISCUSSION,  BUT NOT LIMIT IT TO, THE COST OF SUCH TREATMENT AND MANAGE-
   23  MENT OPTIONS FOR THE LEACHATE RUNOFF FROM HORIZONTAL  OR  BUNKER  SILOS.
   24  THE  GROUP  SHALL ALSO INCLUDE IN THEIR DISCUSSION, BUT NOT LIMIT IT TO,
   25  WAYS TO HELP FARMERS REDUCE THE COST ASSOCIATED WITH THE  TREATMENT  AND
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1  MANAGEMENT  OF LEACHATE RUNOFF FROM HORIZONTAL OR BUNKER SILOS. UPON THE
    2  CONCLUSION OF THEIR STUDY, THE WORKING GROUP  SHALL  PUBLISH  A  REPORT,
    3  THAT  IS  WIDELY  AVAILABLE,  WHICH OUTLINES THE FINDINGS OF THE WORKING
    4  GROUP. THE REPORT SHALL BE SENT TO THE UNITED STATES DEPARTMENT OF AGRI-
    5  CULTURE NATURAL RESOURCE CONSERVATION SERVICE FOR THEIR REVIEW.
    6    4.  IF  THE NEED EXISTS, THE WORKING GROUP MAY CONTINUE TO EXIST AFTER
    7  THE PUBLICATION OF THEIR FINDINGS TO ADDRESS OTHER RELEVANT ISSUES WITH-
    8  IN THEIR COMPETENCY.
    9    S 2. This act shall take effect immediately.
