STATE OF NEW YORK ________________________________________________________________________ 7548 2023-2024 Regular Sessions IN ASSEMBLY May 25, 2023 ___________ Introduced by M. of A. E. BROWN -- read once and referred to the Commit- tee on Local Governments AN ACT to amend the general municipal law, in relation to establishing an administrative adjudication hearing procedure for code and ordi- nance violations for the city of Long Beach The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 380 of the general municipal law is amended by 2 adding a new subdivision 7 to read as follows: 3 7. The city of Long Beach may adopt a local law establishing an admin- 4 istrative adjudication hearing procedure under the provisions of this 5 article for all code and ordinance violations relating to conditions 6 which constitute a threat or danger to the public health, safety or 7 welfare provided, however, that such administrative adjudication hearing 8 procedure shall not apply to violations of the building code of the city 9 of Long Beach. Such administrative adjudication bureau established 10 pursuant to this subdivision may also provide for the hearing and deter- 11 mination of traffic infractions constituting parking, standing or stop- 12 ping violations, provided that the provisions of article two-B of the 13 vehicle and traffic law shall apply to such hearing and determinations. 14 § 2.
