          tee on Health

        AN  ACT  to  amend  the  public health law, in relation to requiring the
          distribution of an information card or sheet with Schedule II opioids

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subdivision 3-a of section 3309 of the public health law,
     2  as amended by chapter 504 of the laws of 2019 and paragraphs (c) and (d)
     3  as amended by chapter 741 of the laws of 2021, is  amended  to  read  as
     4  follows:
     5    3-a.  Any  distribution  of opioid antagonists or opioids listed under
     6  Schedule II of section thirty-three hundred six of  this  title  through
     7  this  program shall include an informational card or sheet. The informa-
     8  tional card or sheet shall include, at a minimum, information on:
     9    (a) how to recognize symptoms of an opioid overdose;
    10    (b) steps to take prior to and after an opioid antagonist is  adminis-
    11  tered, including calling first responders;
    12    (c) opioid addiction and withdrawal symptoms;
    13    (d)  safe  disposal and storage measures for opioids and opioid antag-
    14  onists;
    15    (e) the number for the toll free  office  of  addiction  services  and
    16  supports' HOPE line;
    17    [(d)] (f) how to access the office of addiction services and supports'
    18  website;
    19    [(e)]  (g)  the  application of good samaritan protections provided in
    20  section three thousand-a of this chapter; and
    21    [(f)] (h) any other information deemed relevant by the commissioner.
    22    The educational card shall be provided in languages other than English
    23  as deemed appropriate by the commissioner.  The  department  shall  make
    24  such  informational  cards  available  to the opioid overdose prevention
    25  programs.

     1    § 2. This act shall take effect on the ninetieth day  after  it  shall
     2  have become a law. Effective immediately, the addition, amendment and/or
     3  repeal  of  any  rule  or regulation necessary for the implementation of
     4  this act on its effective date are authorized to be made  and  completed
     5  on or before such effective date.
