       Introduced  by  M.  of  A.  PERRY  -- (at request of the Office of Court
         Administration) -- read once and referred to the Committee on Codes
       AN ACT to amend the criminal procedure law, in relation  to  the  speedy
         trial of certain traffic infractions
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 3 of section 30.30 of  the  criminal  procedure
    2  law is amended by adding a new paragraph (d) to read as follows:
    3    (D)  WHERE  A  MOTION TO DISMISS ALL OFFENSES CHARGED IN AN ACCUSATORY
    4  INSTRUMENT MUST BE GRANTED PURSUANT TO SUBDIVISION ONE OF THIS  SECTION,
    5  AND  SUCH ACCUSATORY INSTRUMENT CHARGES ONE OR MORE TRAFFIC INFRACTIONS,
    6  SUCH TRAFFIC INFRACTION OR INFRACTIONS SHALL ALSO BE DISMISSED.
    7    S 2. This act shall take effect on the first of November next succeed-
    8  ing the date on which it shall have become a law,  and  shall  apply  to
    9  criminal actions commenced after such effective date.
