       AN  ACT  to  amend  the  general  business law, in relation to exempting
         retired police officers in cities of one million  or  more  from  fees
         associated with registration as a security guard
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 10 of section 89-h of the general business law,
    2  as amended by chapter 699 of the laws of 2004, is  amended  to  read  as
    3  follows:
    4    10.  Fees:  pay  (a) a fee of thirty-six dollars for processing of the
    5  application, investigation of the applicant and for the initial biennial
    6  registration period. Such fees shall be deposited to the credit  of  the
    7  business  and  licensing  services  account  established pursuant to the
    8  provisions of section ninety-seven-y of the state finance law; and (b) a
    9  fee pursuant to subdivision eight-a of section eight hundred thirty-sev-
   10  en of the executive law, and amendments thereto, for  the  cost  of  the
   11  division's full search and retain procedures, and a fee as determined by
   12  the  federal  bureau  of  investigation  for the cost of its fingerprint
   13  search procedures, which fees shall be remitted by the department to the
   14  division and federal bureau of investigation. THE FEES REQUIRED BY  THIS
   15  SUBDIVISION SHALL NOT BE APPLICABLE TO RETIRED POLICE OFFICERS IN CITIES
   16  OF ONE MILLION OR MORE; and
   17    S  2.  Subdivision  1  of section 89-m of the general business law, as
   18  added by chapter 336 of the laws of 1992, is amended to read as follows:
   19    1. Registration cards shall expire two years from the date of issuance
   20  or last renewal as the case may be. Not less than sixty  nor  more  than
   21  ninety  days  prior  to  the expiration date of a registration card, the
   22  department shall mail to each  registrant  at  his  OR  HER  last  known
   23  address, notice of renewal and a registration renewal form. Registration
   24  cards  shall  not  be  renewed  unless not more than sixty nor less than

    1  thirty days prior to the expiration date of the registration  card,  the
    2  holder  submits  to the department, a registration renewal form sworn to
    3  or affirmed by the holder under the penalty of perjury together  with  a
    4  biennial renewal fee in the amount of twenty-five dollars payable to the
    5  department  and  a  certificate certifying that the holder has satisfac-
    6  torily completed the required  annual  in-service  training  courses  as
    7  prescribed  by  the  commissioner pursuant to subdivision one of section
    8  eight hundred forty-one-c of the executive law.  Unless  the  department
    9  determines  the  existence  of  facts  which  would constitute cause for
   10  denial, revocation or suspension of the registration  card  pursuant  to
   11  this  article,  it  shall renew the registration card. Denial of renewal
   12  hereunder shall be reviewable by an administrative hearing as set  forth
   13  in section seventy-nine of this chapter. The twenty-five dollar biennial
   14  renewal  fee  collected  by  the  department  shall  be deposited to the
   15  licensing examinations services  account  established  pursuant  to  the
   16  provisions  of  section [97-aa] NINETY-SEVEN-Y of the state finance law.
   17  Notice that a registration card has expired  or  has  not  been  renewed
   18  pursuant  to  this section shall be given by the secretary to the holder
   19  of such registration card and to the security  guard  company  by  which
   20  such  holder was employed at the time of such expiration or non-renewal.
   21  THE FEES REQUIRED BY THIS SUBDIVISION SHALL NOT BE APPLICABLE TO RETIRED
   22  POLICE OFFICERS IN CITIES OF ONE MILLION OR MORE.
   23    S 3. This act shall take effect immediately.
