        AN ACT to amend chapter 430 of the laws of  1963  relating  to  incorpo-
          ration  of  the  Grand Island Volunteer  Firemen's  Benevolent Associ-
          ation and providing for its powers and  duties,  in  relation  to  its
          purpose and the use of foreign fire insurance premium taxes

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 3 of chapter 430 of the laws of  1963  relating  to
     2  incorporation of the Grand Island Volunteer  Firemen's  Benevolent Asso-
     3  ciation  and  providing for its powers and duties, is amended to read as
     4  follows:
     5    § 3. Purposes. The purposes of such corporation shall be  the  mainte-
     6  nance  of  suitable  headquarters  for,  and  the promotion of fraternal
     7  intercourse among the members of such corporation[,];  the  relief,  aid
     8  and assistance of such members and their families who are injured, disa-
     9  bled  or indigent[,]; to promote and safeguard the welfare of the volun-
    10  teer members of the corporation, and their families; to provide for  the
    11  health  and  safety  of the volunteer members of the corporation; and to
    12  enhance the morale of  the  volunteer  members  of  the  corporation  by
    13  providing  social  and recreational activities for the volunteer members
    14  of the corporation, and the promotion of the [welfare of the]  volunteer
    15  fire service within the town of Grand Island and territory provided with
    16  fire protection by contract with such town.
    17    § 2. Section 7 of chapter 430 of the laws of 1963 relating to incorpo-
    18  ration  of the Grand Island Volunteer  Firemen's  Benevolent Association
    19  and providing for its powers and duties, is amended to read as follows:
    20    § 7. Precept for payment of foreign fire insurance premium taxes. Such
    21  corporation shall collect and there  shall  be  paid  to  it  all  taxes
    22  imposed  by section [five hundred fifty-three] nine thousand one hundred
    23  four of the insurance law, for fire departments use  and  benefit,  upon

     1  premiums  for insurance against loss or damage by fire covering property
     2  situated within the territory protected by the  Grand  Island  volunteer
     3  fire  department,  located in the town of Grand Island, Erie county, New
     4  York,  or  within any duly organized territory in which the Grand Island
     5  volunteer fire  department  is  or  may  be  obligated  to  render  fire
     6  protection. The officer of said corporation designated by its by-laws to
     7  collect  and  receive the aforesaid tax shall have all the powers and be
     8  subject to all the provisions of the insurance law, relating to treasur-
     9  ers of fire departments. Such corporation  shall  also  be  entitled  to
    10  receive  a share of the tax imposed by section [five hundred fifty-four]
    11  nine thousand one hundred five of the  insurance  law,  based  upon  the
    12  business  written  in the territory with respect to which it is entitled
    13  to collect and receive the tax under section [five hundred  fifty-three]
    14  nine  thousand  one  hundred four of the insurance law. Such taxes shall
    15  only be used [for the care and relief of disabled or indigent  volunteer
    16  and  exempt  volunteer firemen and their families] by the corporation in
    17  furtherance of its purposes as set forth in section three of this act.
    18    § 3. This act shall take effect immediately and shall apply  to  taxes
    19  due on premiums received on and after January 1, 2024.
