STATE OF NEW YORK ________________________________________________________________________ 7238 2017-2018 Regular Sessions IN ASSEMBLY April 12, 2017 ___________ Introduced by M. of A. THIELE -- read once and referred to the Committee on Ways and Means AN ACT to amend the tax law, in relation to extending the expiration of the authority granted to the county of Suffolk to impose hotel and motel taxes and authorizing ten percent of all revenues collected from said tax shall be paid to the town supervisors of the towns of East Hampton, Riverhead, Shelter Island, Southampton, and Southold for the purposes of expanding and promoting public transit in said towns in conjunction with the Long Island Rail Road in order to foster economic development The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivisions 6 and 7 of section 1202-o of the tax law, 2 subdivision 6 as amended by chapter 159 of the laws of 2009 and subdivi- 3 sion 7 as amended by chapter 348 of the laws of 2015, are amended to 4 read as follows: 5 (6) Such local law shall provide that all revenues resulting from the 6 imposition of the tax payable hereunder shall be paid into the treasury 7 of the county of Suffolk and shall be distributed within thirty days of 8 receipt by the county under the following formula: (a) twenty-four 9 percent of all revenues collected, but not more than two million dollars 10 per fiscal year, shall be delivered to the tourism promotion agency 11 which the county of Suffolk contracts with pursuant to the provisions of 12 subdivision five of this section; (b) ten percent of all revenues 13 collected shall be utilized by the county of Suffolk in support of 14 cultural programs and activities relevant to the continuation and 15 enhancement of the tourism industry which may be increased one percent 16 each county fiscal year by the Suffolk county legislature to an amount 17 not to exceed fifteen percent of all revenues collected as such legisla- 18 ture reduces the allocation for the purposes of paragraph (c) of this 19 subdivision; (c) ten percent of all revenues collected shall be utilized EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD09454-01-7A. 7238 2 1 by the county of Suffolk for the support of any museum accredited by the 2 American Association of Museums, which is located in such county's first 3 dedicated park and is also listed on the National Register of Historic 4 Places, such amount may be decreased one percent each county fiscal year 5 by the Suffolk county legislature to an amount not less than five 6 percent of all revenues collected; (d) eight percent of all revenues 7 collected shall be utilized by the county of Suffolk for the support of 8 other museums, and historical societies, historic residences and histor- 9 ic birthplaces, provided that of such eight percent, an amount equal to 10 one and one-half percent of all revenue collected shall be utilized by 11 the county of Suffolk for program support of a not-for-profit museum 12 organization that manages a National Register of Historic Places site in 13 Suffolk county that has been named a National Treasure, is part of a 14 National Recreational Trail and is a New York state historic site; (e) 15 twenty percent of all revenues collected shall be utilized by the county 16 of Suffolk for the care, maintenance, and interpretation for the general 17 public of the historic structures, sites and unique natural areas that 18 are managed by the Suffolk county department of parks and recreation for 19 sites and activities that are open to tourists on a regular and predict- 20 able basis; (f) not more than two percent of all revenues collected by 21 the county of Suffolk for the promotion of the county of Suffolk as a 22 film friendly location through the county department of economic devel- 23 opment and workforce housing; (g) ten percent of all revenues collected 24 shall be paid to the town supervisors of the towns of East Hampton, 25 Riverhead, Shelter Island, Southampton, and Southold for the purposes of 26 expanding and promoting public transit in said towns in conjunction with 27 the Long Island Rail Road; said revenues shall be apportioned to each 28 town based upon population; and [(g)] (h) all remaining revenue 29 collected by the county of Suffolk shall be deposited into the general 30 fund of such county to be utilized for general park purposes. 31 Schedules of availability of all historic and cultural activities and 32 events funded from any part of these revenues shall be provided to the 33 aforementioned tourism promotion agency which is contracted with by the 34 county of Suffolk so as to enhance tourism promotion and tourist visita- 35 tion. 36 Annually, the department of economic development and workforce housing 37 of the county of Suffolk shall submit, to the county executive and the 38 county legislature of such county, a report on such department's 39 progress on the promotion of the county of Suffolk as a film friendly 40 location, and annual statistics of the revenue generated pursuant to 41 paragraph (f) of this subdivision. 42 (7) Such local law shall provide for the imposition of a hotel or 43 motel tax until December thirty-first, two thousand [seventeen] twenty- 44 two. 45 § 2. This act shall take effect immediately.
