        AN  ACT to amend the public health law, in relation to emergency medical
          service in Nassau County
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1. Section 3017 of the public health law, as added by chapter
     2  572 of the laws of 1994, is amended to read as follows:
     3    § 3017. Emergency medical service, Nassau and Suffolk  [county]  coun-
     4  ties.  1.  No  ambulance service or advanced life support first response
     5  service shall respond to any  call  or  request  for  emergency  medical
     6  services  within  a  town, village or fire district in Nassau or Suffolk
     7  county that  currently  provides  ambulance  service  or  advanced  life
     8  support  services first response service, if the municipality has desig-
     9  nated one or more ambulance services  or  advanced  life  support  first
    10  response services to respond to such calls unless:
    11    (a) the service is so designated;
    12    (b)  the  response is in accordance with a mutual aid plan approved by
    13  the appropriate regional emergency medical service council;
    14    (c) the response is to a verbal mutual aid request from  a  designated
    15  service;
    16    (d)  the  service was specifically requested to respond by the patient
    17  or someone acting on behalf of that patient; or
    18    (e) the response site is a hospital  licensed  under  article  twenty-
    19  eight of this chapter for a transfer to another such facility.
    20    2.  Every  ambulance  service  or advanced life support first response
    21  service shall disclose as part of any solicitation or  advertisement  in
    22  Nassau  or  Suffolk county that there is a fee for services rendered, if
    23  in fact there is a fee charged for the performance of such service.
    24    3. Every ambulance service or advanced  life  support  first  response
    25  service that operates in Nassau or Suffolk county and has vehicles which

     1  travel through communities with designated ambulance service or advanced
     2  life  support first response service shall require its drivers and emer-
     3  gency medical technicians:
     4    (a)  to  immediately notify a central alarm or other publicly operated
     5  dispatch entity, or a person designated under section two hundred nine-b
     6  of the general municipal law to receive calls for emergency services for
     7  the purpose of dispatching emergency medical services whenever an  emer-
     8  gency is found in a public place;
     9    (b) to evaluate the need to transport any patient found in extremis to
    10  a hospital; and
    11    (c)  to comply with appropriate instructions from the dispatch entity.
    12  The dispatch entity, when  appropriate,  may  instruct  the  service  to
    13  transport any patient to an appropriate hospital.
    14    § 2. This act shall take effect immediately.
