       AN ACT to amend the transportation law, in  relation  to  requiring  the
         provision  of  assistive  listening  systems in New York state airport
         terminals and railway stations
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The transportation law is amended by adding a new section
    2  15-d to read as follows:
    3    S 15-D. ACCESSIBLE TRANSPORTATION SYSTEM; ASSISTIVE LISTENING SYSTEMS.
    4  1. ALL PUBLIC-USE AIRPORT TERMINALS AND RAILROAD STATIONS LOCATED WITHIN
    5  THE STATE SHALL BE EQUIPPED WITH AN ASSISTIVE LISTENING SYSTEM  FOR  USE
    6  BY  HEARING  IMPAIRED  PERSONS  WHO  REQUIRE THE USE OF SUCH A SYSTEM TO
    7  IMPROVE THEIR RECEPTION OF SOUND. STANDARDS FOR SUCH  SYSTEMS  SHALL  BE
    8  DEVELOPED  BY  THE  STATE FIRE PREVENTION AND BUILDING CODE COUNCIL UPON
    9  RECEIVING RECOMMENDATIONS FROM THE ADVISORY BOARD ON ASSISTIVE LISTENING
   10  SYSTEMS IN PLACES OF PUBLIC ASSEMBLY, AND SHALL PROVIDE  THE  CAPABILITY
   11  FOR:
   12    (A)  ANNOUNCEMENTS TO PASSENGERS, INCLUDING EMERGENCY INSTRUCTIONS, TO
   13  BE CAPTIONED IN REAL TIME ON SCREENS IN AIRPORTS AND RAIL STATIONS;
   14    (B) PROMINENTLY DISPLAY APPROPRIATE SIGNAGE, EMPLOYING  THE  UNIVERSAL
   15  SYMBOLS,  INDICATING THAT AN ASSISTIVE LISTENING SYSTEM IS AVAILABLE AND
   16  EXPLAINING HOW THE SYSTEM WORKS AND HOW TO ACCESS IT; AND
   17    (C) EXISTING MICROPHONE SYSTEMS TO  EMPLOY  A  HEARING-AID  COMPATIBLE
   18  ASSISTIVE  LISTENING  SYSTEM AND DISPLAY THE UNIVERSAL SYMBOL FOR ASSIS-
   19  TIVE LISTENING AT TICKETING AND INFORMATION BOOTHS.
   20    2. THE COMMISSIONER IS AUTHORIZED TO PROMULGATE SUCH RULES  AND  REGU-
   21  LATIONS AS HE OR SHE DEEMS NECESSARY TO CARRY OUT THE PROVISIONS OF THIS
   22  SUBDIVISION.
   23    3.  THE  PROVISIONS  OF  THIS  SECTION  SHALL NOT APPLY TO PRIVATE-USE
   24  AIRPORTS OR RAILROAD TERMINALS.

    1    4. ALL FACILITIES SUBJECT TO THE PROVISIONS OF THIS SECTION SHALL HAVE
    2  A COMPLIANT ASSISTIVE  LISTENING  SYSTEM  INSTALLED  AND  AVAILABLE  FOR
    3  PUBLIC  USE  BY  A  DATE  NO  LATER THAN JULY TWENTY-SIXTH, TWO THOUSAND
    4  FIFTEEN.
    5    5. FOR PURPOSES OF THIS SECTION:
    6    A.  "AIRPORT" HAS THE SAME MEANING AS SUCH TERM IS DEFINED IN SUBDIVI-
    7  SION FIVE OF SECTION TWO HUNDRED FORTY OF THE GENERAL BUSINESS LAW;
    8    B. "ASSISTIVE LISTENING SYSTEM" SHALL MEAN SITUATIONAL-PERSONAL ACOUS-
    9  TIC COMMUNICATION EQUIPMENT DESIGNED TO  IMPROVE  THE  TRANSMISSION  AND
   10  AUDITORY RECEPTION OF SOUND. SUCH SYSTEM SHALL INCLUDE BUT NOT BE LIMIT-
   11  ED  TO  THE  USE  OF STANDARD AMPLITUDE MODULATION (AM), FREQUENCY MODU-
   12  LATION (FM), AUDIO INDUCTION LOOP, INFRARED LIGHT SOUND,  OR  HARD  WIRE
   13  SYSTEMS;
   14    C.  "PRIVATE-USE"  REFERS  TO  AN AIRPORT TERMINAL OR RAILROAD STATION
   15  USED EXCLUSIVELY BY THE OWNER THEREOF AND  PERSONS  AUTHORIZED  BY  SUCH
   16  OWNER;
   17    D.  "PUBLIC-USE"  REFERS  TO  AN  AIRPORT TERMINAL OR RAILROAD STATION
   18  AVAILABLE FOR USE BY THE GENERAL PUBLIC WITHOUT A  REQUIREMENT  FOR  THE
   19  PRIOR  APPROVAL  OF  THE  OWNER  OR  OPERATOR  THEREOF  EXCEPT AS MAY BE
   20  REQUIRED BY FEDERAL LAW OR REGULATION; AND
   21    E. "RAILROAD" HAS THE SAME MEANING AS SUCH TERM IS DEFINED IN  SECTION
   22  TWO OF THIS CHAPTER.
   23    S 2. The transportation law is amended by adding a new section 15-e to
   24  read as follows:
   25    S  15-E.  VISUAL  EMERGENCY ALARM. 1. ALL PUBLIC USE AIRPORT TERMINALS
   26  AND RAILROAD STATIONS SHALL BE EQUIPPED WITH A VISUAL ALARM ELEMENT  FOR
   27  EMERGENCY  EVACUATION  MEASURES  FOR  USE BY HEARING IMPAIRED PERSONS NO
   28  LATER THAN JANUARY FIRST, TWO THOUSAND FIFTEEN.
   29    2. STANDARDS FOR SUCH ALARMS SHALL BE  DEVELOPED  BY  THE  STATE  FIRE
   30  PREVENTION AND BUILDING CODE COUNCIL UPON RECEIVING RECOMMENDATIONS FROM
   31  THE  ADVISORY  BOARD  ON ASSISTIVE LISTENING SYSTEMS IN PLACES OF PUBLIC
   32  ASSEMBLY; PROVIDED THAT SUCH VISUAL ELEMENT SHALL BE DESIGNED  TO  MINI-
   33  MIZE  THE POSSIBILITY OR RISK OF TRIGGERING SEIZURES IN PERSONS WHO HAVE
   34  EPILEPSY OR PHOTOSENSITIVITY.
   35    S 3. This act shall take effect on the first of January next  succeed-
   36  ing  the  date on which it shall have become a law; provided that effec-
   37  tive immediately, the addition, amendment and/or repeal of any  rule  or
   38  regulation necessary for the implementation of this act on its effective
   39  date  are  authorized and directed to be made and completed on or before
   40  such effective date.
