STATE OF NEW YORK ________________________________________________________________________ 7002 2023-2024 Regular Sessions IN ASSEMBLY May 10, 2023 ___________ Introduced by M. of A. CHANG -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to withholding the gover- nor and lieutenant governor's salaries until the legislative passage of the budget occurs The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The executive law is amended by adding a new section 13 to 2 read as follows: 3 § 13. Compensation of the governor and lieutenant governor; legisla- 4 tive passage of the budget. 1. If legislative passage of the budget has 5 not occurred prior to the first day of any fiscal year, the governor and 6 lieutenant governor's bi-weekly salary installment payments to be paid 7 on or after such day shall be withheld and not paid until such legisla- 8 tive passage of the budget has occurred whereupon bi-weekly salary 9 installment payments shall resume and an amount equal to the accrued, 10 withheld and unpaid installments shall be promptly paid. 11 2. For the purposes of this section, "legislative passage of the budg- 12 et" shall mean that the appropriation bill or bills submitted by the 13 governor pursuant to section three of article seven of the state consti- 14 tution have been finally acted on by both houses of the legislature in 15 accordance with article seven of the state constitution and the state 16 comptroller has determined that such appropriation bill or bills that 17 have been finally acted on by the legislature are sufficient for the 18 ongoing operation and support of state government and local assistance 19 for the ensuing fiscal year. In addition, legislation submitted by the 20 governor pursuant to section three of article seven of the state consti- 21 tution determined necessary by the legislature for the effective imple- 22 mentation of such appropriation bill or bills shall have been acted on. 23 § 2.
