COOK, HYNDMAN -- read once and referred to the Committee on Tourism, Parks, Arts and Sports Development -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the navigation law, in relation to requiring working carbon monoxide detectors to be carried on closed bow boats The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 40 of the navigation law is amended by adding a new 2 subdivision 9-a to read as follows: 3 9-a. Carbon monoxide detectors. (a) No vessel that has an enclosed 4 accommodation compartment may be operated on any navigable waters of the 5 state unless such vessel is equipped with a functioning carbon monoxide 6 detection system appropriate for such vessel and according to the 7 manufacturer's instruction. For the purpose of this section, an 8 "enclosed accommodation compartment" means one contiguous space, 9 surrounded by boat structure that contains all of the following: 10 (i) designated sleeping accommodations; 11 (ii) a galley area with sink; and 12 (iii) a head compartment. 13 (b) After the effective date of this subdivision, no new vessel that 14 has an enclosed accommodation compartment may be sold or offered for 15 sale in the state unless such vessel is equipped with a new functioning 16 carbon monoxide detection system installed according to the manufactur- 17 er's instructions. 18 § 2. This act shall take effect on the one hundred eightieth day after 19 it shall have become a law. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
