STATE OF NEW YORK ________________________________________________________________________ 6508--A 2021-2022 Regular Sessions IN ASSEMBLY March 19, 2021 ___________ Introduced by M. of A. STIRPE, BUTTENSCHON -- read once and referred to the Committee on Corporations, Authorities and Commissions -- commit- tee discharged, bill amended, ordered reprinted as amended and recom- mitted to said committee AN ACT to amend the business corporation law and the limited liability company law, in relation to directing the department of state to provide information to certain new businesses The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 303 of the business corporation law is amended by 2 adding a new paragraph (g) to read as follows: 3 (g) Upon the receipt of an application to reserve a corporate name by 4 the department of state pursuant to this section, the department shall 5 confirm such receipt by mail or email to the applicant at the address or 6 email address set forth in such application. In addition, the department 7 shall include, but not be limited to including, the following informa- 8 tion in such mailing or email: 9 (1) contact information, including, but not limited to website, 10 address and telephone number, of the New York state small business 11 development center serving their region; 12 (2) contact information, including, but not limited to website, 13 address and telephone number, of the New York state entrepreneurship 14 assistance center serving their region; 15 (3) contact information, including, but not limited to the website, 16 address and telephone number of business mentor NY; and 17 (4) contact information, including, but not limited to website, 18 address and telephone number, of empire state development. Information 19 regarding empire state development shall include direction to resources 20 available on such website to support and assist new businesses. 21 § 2. Section 205 of the limited liability company law is amended by 22 adding a new subdivision (e) to read as follows: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD02020-04-1A. 6508--A 2 1 (e) Upon the receipt of an application to reserve a limited liability 2 company name by the department of state pursuant to this section, the 3 department shall confirm such receipt by mail or email to the applicant 4 at the address or email address set forth in such application. In addi- 5 tion, the department shall include, but not be limited to including, the 6 following information in such mailing or email: 7 (1) contact information, including, but not limited to website, 8 address and telephone number, of the New York state small business 9 development center serving their region; 10 (2) contact information, including, but not limited to website, 11 address and telephone number, of the New York state entrepreneurship 12 assistance center serving their region; 13 (3) contact information, including, but not limited to the website, 14 address and telephone number of business mentor NY; and 15 (4) contact information, including, but not limited to website, 16 address and telephone number, of empire state development. Information 17 regarding empire state development shall include direction to resources 18 available on such website to support and assist new businesses. 19 § 3. This act shall take effect on the sixtieth day after it shall 20 have become a law.
