       AN ACT to amend the penal law, in relation to sentencing
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 3 of section 70.08 of the penal law, as amended
    2  by  section 7 of chapter 107 of the laws of 2006, is amended by adding a
    3  new paragraph (d) to read as follows:
    4    (D) FOR A CLASS E FELONY THE MINIMUM PERIOD MUST  BE  AT  LEAST  THREE
    5  YEARS AND MUST NOT EXCEED TWENTY-FIVE YEARS.
    6    S  2.  Subdivision  3 of section 70.08 of the penal law, as amended by
    7  section 8 of chapter 107 of the laws of 2006, is amended by adding a new
    8  paragraph (d) to read as follows:
    9    (D) FOR A CLASS E FELONY THE MINIMUM PERIOD MUST  BE  AT  LEAST  THREE
   10  YEARS AND MUST NOT EXCEED TWENTY-FIVE YEARS.
   11    S  3.  This  act shall take effect immediately; provided, however that
   12  this act shall apply to offenses committed on or  after  such  effective
   13  date;  and  provided  further  that  the  amendments to subdivision 3 of
   14  section 70.08 of the penal law made by section one of this act shall  be
   15  subject  to the expiration and reversion of such subdivision pursuant to
   16  subdivision d of section 74 of  chapter  3  of  the  laws  of  1995,  as
   17  amended,  when  upon such date the provisions of section two of this act
   18  shall take effect.
