         tee on Education
       AN  ACT to establish a task force on food, nutrition and physical educa-
         tion to investigate and establish appropriate and healthy  meal  plans
         and physical education standards for New York state schools; making an
         appropriation therefor and providing for the repeal of such provisions
         upon expiration thereof
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The commissioner of health is hereby directed to  create  a
    2  task  force on food, nutrition and physical education to investigate and
    3  establish appropriate and healthy  meal  plans  and  physical  education
    4  standards for New York state schools.
    5    S  2.  The task force shall consist of 15 members and shall be chaired
    6  by the commissioner of health or his designee.  Five  members  shall  be
    7  appointed  by the commissioner of health; two members shall be appointed
    8  upon the recommendation of the commissioner of education; three  members
    9  shall  be appointed upon the recommendation of the governor; two members
   10  shall be appointed upon the recommendation of the speaker of the  assem-
   11  bly;  and  two members shall be appointed upon the recommendation of the
   12  temporary president of the senate. The commissioner of health may invite
   13  appropriate ad hoc representatives from other state and/or  local  agen-
   14  cies  to  serve  on the task force. Vacancies on the task force shall be
   15  filled in the manner provided for original appointments.
   16    S 3. The task force shall report its findings, conclusions and  recom-
   17  mendations  to  the  governor, temporary president of the senate and the
   18  speaker of the assembly by September 1, 2013.
   19    S 4. The sum of twenty-five thousand dollars  ($25,000),  or  so  much
   20  thereof as may be necessary, is hereby appropriated to the department of
   21  health  from any moneys in the state treasury in the general fund to the

    1  credit of the state purposes account not otherwise appropriated, for its
    2  expenses in carrying out the provisions of this act.
    3    S  5.  This act shall take effect immediately and shall remain in full
    4  force and effect until  September  1,  2013  when  upon  such  date  the
    5  provisions of this act shall expire and be deemed repealed.
