       AN ACT to amend the vehicle and traffic law, in relation to  eliminating
         additional fees for special license plates issued to veterans
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivisions 1 and 1-a of section 404 of  the  vehicle  and
    2  traffic law, subdivision 1 as amended by chapter 170 of the laws of 1994
    3  and  subdivision  1-a  as  added by chapter 415 of the laws of 2001, are
    4  amended to read as follows:
    5    1. The commissioner may issue  special  number  plates  to  applicants
    6  therefor  in  the same manner as other number plates are issued pursuant
    7  to this article. Such special number plates shall be  issued  only  upon
    8  payment  of  an annual service charge of twenty-five dollars in addition
    9  to the regular fee prescribed by section four hundred one of this [chap-
   10  ter] ARTICLE. Application for special number plates  shall  be  made  in
   11  accordance with regulations promulgated by the commissioner with respect
   12  to  issuance  of  such number plates.  Provided, however, in lieu of the
   13  annual fee specified herein, the  commissioner  may  establish  specific
   14  categories  of  plates  for which an annual fee of not less than fifteen
   15  dollars nor more than twenty-five dollars may be charged subject to  the
   16  approval of the director of the division of the budget.  NOTWITHSTANDING
   17  ANY  OTHER  PROVISION OF THIS SUBDIVISION OR ANY OTHER PROVISION OF LAW,
   18  ANY REGISTRATION AND SPECIAL NUMBER PLATES  ISSUED  TO  A  PERSON  AS  A
   19  RESULT  OF  SUCH PERSON'S SERVICE IN A BRANCH OF THE ARMED FORCES OF THE
   20  UNITED STATES SHALL BE ACCOMPANIED ONLY BY THE  REQUIRED  FEE  OTHERWISE
   21  REQUIRED TO BE PAID FOR VEHICLE REGISTRATION.
   22    1-a.  The  commissioner  may issue special number plates to applicants
   23  who are members of veterans organizations in the same  manner  as  other
   24  number  plates  are issued pursuant to this article. Such special number

    1  plates shall be issued only upon [(a)  payment  of  a  one-time  service
    2  charge  of  ten  dollars  in  addition  to  the regular registration fee
    3  prescribed by section  four  hundred  one  of  this  article,  and  (b)]
    4  submission  of  proof, satisfactory to the commissioner, that the appli-
    5  cant is presently a member of the veterans organization for  which  such
    6  plate  is  requested.  Such membership shall be verified annually by the
    7  applicant. Application for such plates shall be made in accordance  with
    8  regulations promulgated by the commissioner with respect to the issuance
    9  of  such  plates. Provided, however, that nothing contained herein shall
   10  be deemed to supersede the provisions of section  four  hundred  four-d,
   11  four  hundred  four-e,  four  hundred  four-h, four hundred four-i, four
   12  hundred four-j, four hundred four-k or four hundred four-p of this arti-
   13  cle.
   14    S 2. Subdivision 3 of section 404-h of the vehicle and traffic law, as
   15  amended by chapter 415 of the laws  of  2001,  is  amended  to  read  as
   16  follows:
   17    3. A distinctive plate issued pursuant to this section shall be issued
   18  in  the  same  manner as other number plates upon payment of the regular
   19  registration fee prescribed by section four hundred one of this  article
   20  [provided,  however,  that  an additional one-time service charge of ten
   21  dollars shall be charged for such plate].
   22    S 3. Subdivision 4 of section 404-j of the vehicle and traffic law, as
   23  amended by chapter 415 of the laws  of  2001,  is  amended  to  read  as
   24  follows:
   25    4.  Fee.  A  special  plate  and  registration issued pursuant to this
   26  section shall be issued upon payment of  the  regular  registration  fee
   27  prescribed by section four hundred one of this article [provided, howev-
   28  er,  that  an additional one-time service charge of ten dollars shall be
   29  charged for such plate].
   30    S 4. This act shall take effect immediately.
