TOBACCO -- read once and referred to the Commit- tee on Local Governments AN ACT to amend the town law, in relation to building permits issued in Richmond county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The town law is amended by adding a new section 261-d to 2 read as follows: 3 S 261-D. BUILDING PERMIT PROCESS IN RICHMOND COUNTY. NO BUILDING 4 PERMIT FOR RESIDENTIAL CONSTRUCTION OF A NEW HOME SHALL BE ISSUED BY ANY 5 TOWN LOCATED WITHIN RICHMOND COUNTY UNTIL THE DISTRICT SCHOOL BOARD 6 CERTIFIES TO THE BUILDING DEPARTMENT OR OTHER ENTITY AUTHORIZED TO ISSUE 7 BUILDING PERMITS THAT THERE ARE TWO SEATS AVAILABLE IN SUCH SCHOOL 8 DISTRICT WITHIN THE BOUNDARIES OF THE NEIGHBORHOOD SCHOOL WHERE CHILDREN 9 LIVING IN ANY SUCH HOME WOULD BE ASSIGNED TO ATTEND. 10 S 2. This act shall take effect immediately and shall apply to appli- 11 cations submitted on and after such date.
