        AN ACT to direct the department of civil service to conduct a  study  to
          determine the number of people with a disability employed by agencies;
          and  providing  for  the repeal of such provisions upon the expiration
          thereof

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. 1. The following terms when used in this act shall have the
     2  following meanings:
     3    (a)  "disability"  shall  have  the same meaning as section 292 of the
     4  executive law; and
     5    (b) "agency" shall mean any  department,  board,  bureau,  commission,
     6  division,  office,  council,  committee,  public  benefit corporation or
     7  public authority at least one of  whose  members  is  appointed  by  the
     8  governor.
     9    2. (a) The department of civil service shall conduct a study to deter-
    10  mine  the  number  of people with a disability employed by an agency and
    11  shall make a report including any recommendations to increase the number
    12  of people with disabilities employed by such agencies.
    13    (b) Such report shall also include but not be limited to:
    14    (i) the total number of employees in the state with a disability;
    15    (ii) an agency  by  agency  breakdown  containing  the  percentage  of
    16  employees with a disability;
    17    (iii) a breakdown of the number of employees with a disability who are
    18  part of the civil service;
    19    (iv)  a breakdown of the number of employees with a disability who are
    20  management confidential; and
    21    (v) a breakdown of the number of employees with a disability who serve
    22  in a supervisory role.

     1    3. The department of civil service may request, and is  authorized  to
     2  receive,  any  information from any agency that is relevant and material
     3  to the completion of  such  study.  Such  information  received  by  the
     4  department  of  civil  service shall be subject to the same requirements
     5  for confidentiality and limitations on use, if any, as are applicable to
     6  such  agency's  use  of such information and may only be utilized by the
     7  department and the commissioner of civil service for purposes authorized
     8  by this section.
     9    4. The department of civil service shall  issue  such  report  to  the
    10  governor,  the  temporary  president  of  the senate, the speaker of the
    11  assembly, the minority leader of the senate and the minority  leader  of
    12  the assembly no later than one year from the effective date of this act.
    13  The  contents  of such report shall not contain the personally identifi-
    14  able information of any individual.
    15    § 2. This act shall take effect immediately and shall  expire  and  be
    16  deemed repealed two years after such date.
