TOWNS -- read once and referred to the Committee on Governmental Operations AN ACT to amend the military law, in relation to providing members of the merchant marine opportunity to compete in civil service examina- tions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 243-b of the military law, as amended by chapter 2 425 of the laws of 2005, subdivisions 2 and 3 as amended by chapter 192 3 of the laws of 2008, is amended to read as follows: 4 S 243-b. Civil service examinations by military AND MERCHANT MARINE 5 personnel. 1. Notwithstanding any other provision of this chapter or 6 any other law, any member of the armed forces OR MERCHANT MARINE of the 7 United States of America who having duly filed an application to compete 8 in a scheduled competitive examination for civil service employment by 9 the state of New York or any of its subdivisions and who due to active 10 military duty OR MERCHANT MARINE SERVICE is deprived of the opportunity 11 to compete in such examination shall be provided with an opportunity to 12 compete, under terms and conditions deemed appropriate by the state 13 department of civil service or municipal commission, by way of a special 14 military OR MERCHANT MARINE make-up examination. 15 2. Notwithstanding any other provision of this chapter or any other 16 law, any member of the force of the organized militia, as the term is 17 defined in subdivision nine of section one of this chapter or reserve 18 armed forces, as that term is defined in subdivision twenty-nine of 19 section two hundred ninety-two of the executive law, MERCHANT MARINE or 20 any member of the armed forces of the United States who missed the 21 application deadline for a scheduled competitive examination for civil 22 service employment by the state of New York or any of its subdivisions 23 due to military service, as defined in subdivision one of section three 24 hundred one of this chapter or due to a call to active duty other than EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09587-01-1 A. 5406 2 1 for training, pursuant to 10 USC 101 (d) (1), and is deprived of the 2 opportunity to compete in such examination due to military service, as 3 defined in subdivision one of section three hundred one of this chapter 4 or due to a call to active duty other than for training, pursuant to 10 5 USC 101 (d) (1), shall be provided with an opportunity to compete, under 6 terms and conditions deemed appropriate by the state department of civil 7 service or municipal commission, by way of a special military make-up 8 examination. 9 3. Notwithstanding any other provision of this chapter or any other 10 law, any member of the force of the organized militia, as the term is 11 defined in subdivision nine of section one of this chapter or reserve 12 armed forces, as that term is defined in subdivision twenty-nine of 13 section two hundred ninety-two of the executive law, MERCHANT MARINE or 14 any member of the armed forces of the United States who missed the 15 application deadline for a scheduled competitive examination for civil 16 service employment by the state of New York or any of its subdivisions 17 due to military service, as defined in subdivision one of section three 18 hundred one of this chapter or due to a call to active duty other than 19 for training, pursuant to 10 USC 101 (d) (1), and who returns from such 20 duty prior to the administration of such competitive examination shall 21 be granted a waiver of the application requirement and allowed to 22 compete in such upcoming examination. 23 S 2. This act shall take effect immediately.
