BRENNAN, GLICK -- read once and referred to the Committee on Education -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said commit- tee AN ACT to amend the education law, in relation to eliminating the waiver of qualification requirements for school superintendents in the school districts located in cities having a population of one million or more residents, limiting the term of the chancellor's service and requiring the selection of the chancellor to be made from a list submitted by the city board THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 3 of section 3003 of the education law, as 2 amended by chapter 149 of the laws of 1974, is amended to read as 3 follows: 4 3. [The] EXCEPT IN SCHOOL DISTRICTS LOCATED IN CITIES HAVING A POPU- 5 LATION OF ONE MILLION OR MORE RESIDENTS, THE commissioner, at the 6 request of a board of education or board of cooperative educational 7 services, may provide for the issuance of a certificate as superinten- 8 dent of schools to exceptionally qualified persons who do not meet all 9 of the graduate course or teaching requirements of subdivision one of 10 this section, but whose exceptional training and experience are the 11 substantial equivalent of such requirements and qualify such persons for 12 the duties of a superintendent of schools. 13 S 2. The opening paragraph of section 2590-h of the education law, as 14 amended by chapter 345 of the laws of 2009, is amended to read as 15 follows: 16 S 2590-h. Powers and duties of chancellor. The office of chancellor of 17 the city district is hereby continued. The length of such contract shall not exceed by more than 2 two years the term of office of the mayor authorizing such contract] FOR 3 TWO-YEAR RENEWABLE TERMS. THE MAYOR SHALL SELECT THE CHANCELLOR FROM A 4 LIST OF THREE CANDIDATES PROPOSED BY THE CITY BOARD. The chancellor 5 shall receive a salary to be fixed by the mayor within the budgetary 6 allocation therefor. He or she shall exercise all his or her powers and 7 duties in a manner not inconsistent with the city-wide educational poli- 8 cies of the city board. The chancellor shall have the following powers 9 and duties as the superintendent of schools and chief executive officer 10 for the city district, which the chancellor shall exercise to promote an 11 equal educational opportunity for all students in the schools of the 12 city district, promote fiscal and educational equity, increase student 13 achievement and school performance and encourage local school-based 14 innovation, including the power and duty to: 15 S 3. This act shall take effect immediately; provided that the amend- 16 ments to section 2590-h of the education law made by section two of this 17 act shall not affect the expiration of such section and shall be deemed 18 to expire therewith.
