STATE OF NEW YORK ________________________________________________________________________ 5386 2025-2026 Regular Sessions IN ASSEMBLY February 13, 2025 ___________ Introduced by M. of A. BORES -- read once and referred to the Committee on Codes AN ACT to amend the executive law, in relation to reporting of hate crimes by law enforcement departments The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. This act shall be known and may be cited as the "hate crime 2 accountability and transparency enforcement (HATE) reporting act". 3 § 2. The executive law is amended by adding a new section 837-y to 4 read as follows: 5 § 837-y. Reporting duties of law enforcement departments with respect 6 to hate crimes. 1. The chief of every police department, each county 7 sheriff, and the superintendent of state police shall report, in a 8 manner and timeframe as determined by the division, any instance or 9 occurrence in which a hate crime, as defined in section 485.05 of the 10 penal law, is reported or investigated. The division shall use such 11 reports for the purpose of providing data to federal bureaus or depart- 12 ments engaged in collecting national criminal statistics, including but 13 not limited to the federal bureau of investigation. 14 2. The division shall promulgate rules and regulations to effectuate 15 the reporting of hate crime data to the division by law enforcement 16 departments as required pursuant to subdivision one of this section such 17 that the division may provide hate crime data to federal bureaus or 18 departments engaged in collecting national criminal statistics, includ- 19 ing but not limited to the federal bureau of investigation. 20 § 3.
