Bill Title: Provides that the office of fire prevention and control shall establish and maintain a centralized reporting system and data base of the names and firefighting organizations of all firefighters in the state; requires office of fire prevention and control to issue an annual report on or before March 31 to the governor, temporary president of the senate, speaker of the assembly, minority leader of the senate and the minority leader of the assembly.

       AN  ACT  to  amend the executive law, in relation to establishing a data
         base of all firefighters
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. The executive law is amended by adding a new section 157-a
    2  to read as follows:
    3    S 157-A. FIREFIGHTERS' DATA BASE. 1. THE OFFICE OF FIRE PREVENTION AND
    4  CONTROL SHALL ESTABLISH AND MAINTAIN A CENTRALIZED REPORTING SYSTEM  AND
    5  DATA  BASE OF THE NAMES AND FIREFIGHTING ORGANIZATIONS OF ALL FIREFIGHT-
    6  ERS IN THE STATE.
    7    2. EVERY FIRE DEPARTMENT, FIRE COMPANY, FIRE DISTRICT  AND  ANY  OTHER
    8  ENTITY  EMPLOYING PROFESSIONAL OR VOLUNTEER FIREFIGHTERS SHALL SUBMIT TO
    9  THE OFFICE OF FIRE PREVENTION AND CONTROL A LIST  OF  ALL  OFFICERS  AND
   10  INACTIVE   AND   ACTIVE  FIREFIGHTING  MEMBERS,  ON  OR  BEFORE  JANUARY
   11  THIRTY-FIRST EACH YEAR. SUCH LIST SHALL  INCLUDE  SUCH  INFORMATION  AND
   12  SHALL BE SUBMITTED IN A FORM AS DETERMINED BY THE STATE FIRE ADMINISTRA-
   13  TOR.
   14    3.  FOR  THE  PURPOSES OF THIS SECTION AN "ACTIVE FIREFIGHTING MEMBER"
   15  SHALL BE A FIREFIGHTER WHO: (A) IS A MEMBER OF A FIREFIGHTING  ORGANIZA-
   16  TION,  (B)  REGULARLY  PARTICIPATES  IN  FIREFIGHTING  DUTIES,  (C)  HAS
   17  COMPLETED A BASIC FIREFIGHTING COURSE APPROVED BY THE  FIREFIGHTING  AND
   18  CODE  ENFORCEMENT  PERSONNEL STANDARDS AND EDUCATION COMMISSION, AND (D)
   19  ANNUALLY COMPLETES THE FIRE SAFETY TRAINING COURSE AS  REQUIRED  BY  THE
   20  DEPARTMENT OF LABOR.
   21    4.  ON  OR  BEFORE  MARCH  THIRTY-FIRST  EACH YEAR, THE OFFICE OF FIRE
   22  PREVENTION AND CONTROL SHALL SUBMIT A COPY OF ALL INFORMATION  CONTAINED
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1  IN  THE  FIREFIGHTERS' DATA BASE TO THE GOVERNOR, TEMPORARY PRESIDENT OF
    2  THE SENATE, SPEAKER OF THE ASSEMBLY, MINORITY LEADER OF THE  SENATE  AND
    3  THE MINORITY LEADER OF THE ASSEMBLY.
    4    S 2. This act shall take effect on the first of December next succeed-
    5  ing  the  date  on  which  it shall have become a law, provided that the
    6  office of fire prevention and control shall immediately  promulgate  all
    7  rules  and regulations necessary to carry out the provisions of this act
    8  on its effective date.
