       AN ACT to amend the tax law, in relation to including propane for use in
         motor vehicles as exempt from sales tax
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph 42 of subdivision (a) of section 1115 of the  tax
    2  law,  as  added  by section 11 of part W-1 of chapter 109 of the laws of
    3  2006, is amended to read as follows:
    4    (42) E85, CNG, PROPANE or hydrogen, for use  or  consumption  directly
    5  and exclusively in the engine of a motor vehicle.
    6    S  2.  This  act shall take effect immediately, provided however, that
    7  the amendment to paragraph 42 of subdivision (a) of section 1115 of  the
    8  tax  law  made by this act shall not affect the repeal of such paragraph
    9  and shall be deemed to repeal therewith.
