STATE OF NEW YORK ________________________________________________________________________ 4732 2019-2020 Regular Sessions IN ASSEMBLY February 5, 2019 ___________ Introduced by M. of A. AUBRY -- Multi-Sponsored by -- M. of A. PERRY -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the defense and indem- nification of certain persons serving in the New York city school district The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 2560 of the education law, as 2 amended by chapter 273 of the laws of 1986, is amended to read as 3 follows: 4 1. Notwithstanding any inconsistent provision of law, general, special 5 or local, or the limitation contained in the provisions of any city 6 charter, any duly appointed member of the board of education in a city 7 having a population of one million or more, the members of each communi- 8 ty school board in such city, the teaching or supervising staff, offi- 9 cer, or employee of such board and of each such community school board, 10 member of a committee on special education or subcommittee thereof [or], 11 authorized participant in the school volunteer program in such city, or 12 duly appointed or elected officer of a parents' association in such city 13 shall be entitled to legal representation and indemnification pursuant 14 to the provisions of, and subject to the conditions, procedures and 15 limitations contained in section fifty-k of the general municipal law, 16 except that any judgment or settlement pursuant to this section shall be 17 payable from the monies of the board of education. 18 § 2.
