       AN ACT to amend the general business law, in relation  to  the  sale  of
         alcoholic beverages at customer-operated point-of-sale stations
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The general business law is amended by adding a new section
    2  399-eee to read as follows:
    3    S 399-EEE. PROHIBITED SALE OF ALCOHOLIC BEVERAGES AT CUSTOMER-OPERATED
    4  POINT-OF-SALE STATIONS. 1. SALE OF ALCOHOLIC BEVERAGES BY RETAIL  ESTAB-
    5  LISHMENTS  LICENSED  PURSUANT  TO  THE ALCOHOLIC BEVERAGE CONTROL LAW IS
    6  PROHIBITED AT CUSTOMER-OPERATED POINT-OF-SALE STATIONS.
    7    2. FOR PURPOSES  OF  THIS  SECTION,  "CUSTOMER-OPERATED  POINT-OF-SALE
    8  STATION"  MEANS A SELF-SCANNING CHECKOUT WHERE CUSTOMERS PAY FOR AND BAG
    9  THEIR OWN MERCHANDISE WITHOUT INTERACTING WITH A HUMAN CASHIER.
   10    3. VIOLATION OF THIS SECTION SHALL BE SUBJECT TO A  FINE  OF  NO  LESS
   11  THAN FIVE HUNDRED DOLLARS AND NO MORE THAN ONE THOUSAND DOLLARS.
   12    S 2. This act shall take effect immediately.
