       AN ACT to amend the penal law, in relation  to  creating  the  crime  of
         sports rage in the presence of a minor
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The penal law is amended by adding a new section 240.23  to
    2  read as follows:
    3  S 240.23 SPORTS RAGE IN THE PRESENCE OF A MINOR.
    4    A  PERSON  IS  GUILTY  OF SPORTS RAGE IN THE PRESENCE OF A MINOR WHEN,
    5  WITHOUT REGARD TO THE AFFECT IT  HAS  ON  A  PERSON  UNDER  THE  AGE  OF
    6  SIXTEEN,  A PERSON OVER THE AGE OF EIGHTEEN, WHO IS A NON-PARTICIPANT IN
    7  THE SPORTING EVENT, RECKLESSLY ENDANGERS THE SAFETY  OF  SUCH  MINOR  BY
    8  ENGAGING  IN  FIGHTING OR IN VIOLENT, TUMULTUOUS OR THREATENING BEHAVIOR
    9  AT A PROFESSIONAL, NON-PROFESSIONAL OR YOUTH SPORTING EVENT WHILE IN THE
   10  PRESENCE OF ONE OR MORE PERSONS UNDER THE AGE OF SIXTEEN.
   11    SPORTS RAGE IN THE PRESENCE OF A MINOR IS A CLASS B MISDEMEANOR.
   12    S 2. This act shall take effect on the first of November next succeed-
   13  ing the date on which it shall have become a law.
