        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          providing  that one hundred percent of in-state sales of new passenger
          cars and trucks shall be zero-emissions by two thousand thirty-five

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The environmental conservation law is amended by adding a
     2  new section 19-0306-b to read as follows:
     3  § 19-0306-b. Zero-emissions cars and trucks.
     4    1. It shall be a goal of the state that one  hundred  percent  of  new
     5  passenger cars and trucks offered for sale or lease, or sold, or leased,
     6  for  registration  in  the state shall be zero-emissions by two thousand
     7  thirty-five.  It shall be a further goal of the state that  one  hundred
     8  percent  of  medium-duty  and  heavy-duty  vehicles  offered for sale or
     9  lease, or sold, or leased, for registration in the state  be  zero-emis-
    10  sions  by  two thousand forty-five for all operations where feasible. It
    11  shall be further a goal of  the  state  to  transition  to  one  hundred
    12  percent  zero-emissions  off-road vehicles and equipment by two thousand
    13  thirty-five where feasible.
    14    2. The department, to the extent consistent with  federal  law,  shall
    15  develop and propose:
    16    a.  Passenger  vehicle  and  truck  regulations  requiring  increasing
    17  volumes of new zero-emissions vehicles offered for  sale  or  lease,  or
    18  sold, or leased, for registration in the state towards the target of one
    19  hundred percent of in-state sales by two thousand thirty-five.
    20    b. Medium-duty and heavy-duty vehicle regulations requiring increasing
    21  volumes  of  new  zero-emissions  trucks  and  buses offered for sale or
    22  lease, or sold, or leased, for registration and operated  in  the  state
    23  towards  the target of one hundred percent of the fleet transitioning to
    24  zero-emissions vehicles by two thousand forty-five everywhere feasible.

     1    c. Strategies, in coordination  with  other  state  agencies  and  the
     2  federal  environmental protection agency, to achieve one hundred percent
     3  zero-emissions from off-road vehicles and equipment  operations  in  the
     4  state  by  two thousand thirty-five.   In implementing the provisions of
     5  this paragraph, the department shall act consistently with safety, tech-
     6  nological feasibility and cost-effectiveness.
     7    3.  The  department,  in  consultation with the department of economic
     8  development, the New York state energy research and development authori-
     9  ty, the public service commission, the department of transportation, the
    10  department of motor vehicles, and other state agencies,  local  agencies
    11  and  other  interested  parties,  shall develop a zero-emissions vehicle
    12  market development strategy by January thirty-first, two thousand  twen-
    13  ty-three, and an update every three years thereafter, that:
    14    a. Ensures coordinated and expeditious implementation of the system of
    15  policies,  programs  and  regulations necessary to achieve the goals and
    16  orders established by this section.
    17    b. Outlines state agencies' actions to support new and used zero-emis-
    18  sions vehicle markets for broad accessibility for all residents of  this
    19  state.
    20    4.  The department, the New York state energy research and development
    21  authority, the public service commission and other state agencies, shall
    22  use existing authorities to accelerate deployment of affordable powering
    23  options for zero-emissions vehicles, in ways that serve all  communities
    24  and  particularly  low-income  and disadvantaged communities, consistent
    25  with state and federal law.
    26    5. The department, the New York state energy research and  development
    27  authority, the department of motor vehicles and the department of trans-
    28  portation,  in  consultation  with the other state agencies, shall on or
    29  before July fifteenth, two thousand  twenty-three,  identify  near  term
    30  actions and investment strategies to improve sustainable transportation,
    31  freight and transit options, including where feasible:
    32    a.  Supporting bicycle and pedestrian options, particularly in low-in-
    33  come and disadvantaged communities in the state, by  incorporating  safe
    34  and accessible infrastructure into projects where appropriate.
    35    b.  Supporting  light,  medium, and heavy-duty zero-emissions vehicles
    36  and infrastructure as part  of  larger  transportation  projects,  where
    37  appropriate.
    38    § 2. This act shall take effect immediately.
