AN ACT to amend the environmental conservation law, in relation to
requiring local approval for using construction and demolition debris
as fill for mined land reclamation
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Section 23-2713 of the environmental conservation law is
2 amended by adding a new subdivision 3 to read as follows:
3 3. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, NO MINING PLAN OR
4 RECLAMATION PLAN SHALL PROPOSE TO UTILIZE CONSTRUCTION AND DEMOLITION
5 DEBRIS AS FILL WITHOUT THE APPROVAL OF THE CITY, TOWN OR VILLAGE WHERE
6 THE AFFECTED LAND IS LOCATED.
7 S 2. This act shall take effect immediately.
