       AN  ACT  to amend the banking law, in relation to allowing credit unions
         to offer membership to the  domestic  partners  of  persons  otherwise
         eligible for membership in such credit union
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subparagraph 1 of paragraph (d) of subdivision 2 of section
    2  451 of the banking law, as amended by chapter 660 of the laws  of  2004,
    3  is amended to read as follows:
    4    (1)  in each instance where a person is a member or is directly eligi-
    5  ble for membership, members of his or her immediate family or  household
    6  shall be eligible for membership. For the purposes of this subparagraph,
    7  "immediate  family"  means  a  person's  spouse OR DOMESTIC PARTNER, and
    8  their lineal ancestors and descendants, including persons so related  by
    9  adoption,  siblings,  stepparents,  stepchildren,  and stepsiblings; and
   10  "household" means persons living in the same residence and maintaining a
   11  single economic unit;
   12    S 2. Section 451 of the banking law is amended by adding a new  subdi-
   13  vision 18 to read as follows:
   14    18.  FOR  THE  PURPOSES  OF  THIS  SECTION, "DOMESTIC PARTNER" MEANS A
   15  PERSON WHO, WITH RESPECT TO ANOTHER PERSON:
   16    (A) IS FORMALLY A PARTY IN A DOMESTIC PARTNERSHIP OR SIMILAR RELATION-
   17  SHIP WITH THE OTHER PERSON, ENTERED INTO PURSUANT TO  THE  LAWS  OF  THE
   18  UNITED  STATES OR OF ANY STATE, LOCAL OR FOREIGN JURISDICTION, OR REGIS-
   19  TERED AS THE DOMESTIC PARTNER OF THE  OTHER  PERSON  WITH  ANY  REGISTRY
   20  MAINTAINED  BY  THE EMPLOYER OF EITHER PARTY OR ANY STATE, MUNICIPALITY,
   21  OR FOREIGN JURISDICTION; OR
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1    (B) IS FORMALLY RECOGNIZED AS A BENEFICIARY OR  COVERED  PERSON  UNDER
    2  THE OTHER PERSON'S EMPLOYMENT BENEFITS OR HEALTH INSURANCE; OR
    3    (C)  IS  DEPENDENT  OR MUTUALLY INTERDEPENDENT ON THE OTHER PERSON FOR
    4  SUPPORT, AS EVIDENCED BY THE TOTALITY OF THE CIRCUMSTANCES INDICATING  A
    5  MUTUAL  INTENT  TO  BE  DOMESTIC  PARTNERS INCLUDING BUT NOT LIMITED TO:
    6  COMMON OWNERSHIP OR JOINT LEASING OF REAL OR PERSONAL  PROPERTY;  COMMON
    7  HOUSEHOLDING,  SHARED  INCOME  OR  SHARED  EXPENSES; CHILDREN IN COMMON;
    8  SIGNS OF INTENT TO MARRY OR BECOME DOMESTIC PARTNERS UNDER PARAGRAPH (A)
    9  OR (B) OF THIS SUBDIVISION; OR THE LENGTH OF THIS PERSONAL  RELATIONSHIP
   10  OF THE PERSONS.
   11    S 3. This act shall take effect immediately.
