AN ACT to amend the real property law, in relation to including a condo-
minium where the town of East Hampton or its housing authority is the
holder of the landlord's interest as a qualified leasehold condominium
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Subdivision 12 of section 339-e of the real property law,
2 as amended by chapter 234 of the laws of 2009, is amended to read as
3 follows:
4 12. "Qualified leasehold condominium" means any leasehold interest in
5 real property intended to be used for either residential purposes,
6 commercial purposes, industrial purposes or any combination of such
7 purposes, together with any fee simple absolute or leasehold interest in
8 the buildings and all other improvements which have been or at any time
9 hereafter may be erected upon such real property, which has been or is
10 intended to be submitted to the provisions of this article, provided
11 that, on the date of the recording of the declaration: (i) the battery
12 park city authority or the Roosevelt Island operating corporation is the
13 holder of the tenant's interest in such leasehold interest or (ii) the
14 Queens West development corporation is the holder of the landlord's

1 interest in such leasehold interest or (iii) the Brooklyn bridge park
2 development corporation is the holder of the landlord's interest in such
3 leasehold interest[,] or (iv) the New York city educational construction
4 fund is the holder of the landlord's interest in such leasehold interest
5 for property located in the borough of Manhattan, in the city of New
6 York, bounded on the east by Second Ave, on the west by Third Avenue, to
7 the north by East Fifty-seventh Street, and to the south by East Fifty-
8 sixth Street, OR (V) THE TOWN OF EAST HAMPTON OR THE TOWN OF EAST HAMP-
9 TON HOUSING AUTHORITY IS THE HOLDER OF THE LANDLORD'S INTEREST IN SUCH
10 LEASEHOLD INTEREST.
11 S 2. This act shall take effect immediately.
