        AN ACT to amend the vehicle and traffic law, in relation  to  dishonored
          check fees
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Section 202-b of the vehicle and traffic law, as amended by
     2  chapter 236 of the laws of 2013, is amended to read as follows:
     3    § 202-b. Penalties for submission of dishonored checks and credit card
     4  payments. (a) A thirty-five dollar penalty fee shall be charged  to  any
     5  person who has submitted a check to the commissioner or his or her agent
     6  as  payment for any license, permit or registration or any other type of
     7  fee for any type of transaction as required by  this  chapter  and  such
     8  check  has  been  dishonored.  Such  thirty-five dollar penalty shall be
     9  added to the amount due to the commissioner. In addition,  [any  or  all
    10  licenses,  permits or registrations] the license, permit or registration
    11  issued in the name of such person for which such check was submitted may
    12  be suspended [and, if a suspension has been  issued,  any  other  trans-
    13  action  in the name of such person with this department may be prohibit-
    14  ed] until full satisfaction of the amount due to  the  commissioner  and
    15  the  thirty-five dollar penalty fee is paid to the commissioner. No such
    16  suspension shall be issued until thirty days after notification that the
    17  check has been dishonored is mailed to such person. If  satisfaction  is
    18  made  within  thirty days from the date of mailing of such notification,
    19  no suspension shall be issued. (b) In any case where a person has made a
    20  credit card payment to the commissioner or his or her agent  as  payment
    21  for any license, permit or registration or any other type of fee for any
    22  type  of  transaction  as required by this chapter, and such credit card
    23  payment is contested and is not honored by the credit card company,  any
    24  other  transaction in the name of such person with the department may be

     1  prohibited, upon at least thirty days notice, until full satisfaction of
     2  the amount due to the commissioner has been paid.
     3    §  2.  This  act shall take effect on the ninetieth day after it shall
     4  have become a law.
