       AN  ACT  to amend the general business law, in relation to requiring gas
         stations to maintain a backup generator to operate gas  pumps  in  the
         event of loss of electricity
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The general business law is amended by adding a new section
    2  399-eee to read as follows:
    3    S 399-EEE. PLACEMENT OF BACKUP GENERATORS AT GAS STATIONS. 1.    EVERY
    4  RETAIL  GAS STATION LOCATED WITHIN THIS STATE SHALL BE REQUIRED TO MAIN-
    5  TAIN A BACKUP GENERATOR CAPABLE OF OPERATING ALL GAS PUMPS  SITUATED  ON
    6  THE PROPERTY FOR A PERIOD OF NO LESS THAN FORTY-EIGHT HOURS IN THE EVENT
    7  THAT THE RETAIL GAS STATION LOSES ITS MAIN SOURCE OF ELECTRICITY.
    8    2.  FOR  PURPOSES  OF  THIS SECTION, "RETAIL GAS STATION" SHALL MEAN A
    9  FILLING STATION WHERE GASOLINE IS STORED PRIMARILY FOR SALE BY  DELIVERY
   10  DIRECTLY  INTO  THE  ORDINARY  FUEL  TANK CONNECTED WITH THE ENGINE OF A
   11  MOTOR VEHICLE OR VESSEL TO BE CONSUMED IN THE OPERATION  OF  SUCH  MOTOR
   12  VEHICLE OR VESSEL.
   13    S 2. This act shall take effect on the one hundred eightieth day after
   14  it shall have become a law.
