        AN ACT to amend the environmental conservation law, in relation to inva-
          sive species
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subdivision 10  of  section  9-1703  of  the  environmental
     2  conservation  law,  as  added  by  chapter  674  of the laws of 2007, is
     3  amended to read as follows:
     4    10. "Invasive species" means a species that is:
     5    (a) nonnative to the ecosystem under consideration; and
     6    (b) whose introduction causes or is likely to cause economic or  envi-
     7  ronmental  harm  or harm to human health. For the purposes of this para-
     8  graph, the harm must significantly outweigh any benefits; or
     9    (c) present in numbers that such species or pest organisms are consid-
    10  ered an infestation and large enough  to  be  harmful,  threatening,  or
    11  obnoxious  to  native  plants,  animals,  or  human health. These should
    12  include, but not be limited to, infestations related  to  the  prolifer-
    13  ation  of vector-borne diseases such as Lyme and tick-borne diseases and
    14  the West Nile virus.
    15    § 2. This act shall take effect immediately.
