       AN ACT to amend the education law, in relation to attendance of minors
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Section  3205 of the education law is amended by adding a
    2  new subdivision 4 to read as follows:
    3    4. COMMENCING  DECEMBER  FIRST,  TWO  THOUSAND  FIFTEEN,  EACH  SCHOOL
    4  DISTRICT  OF  THE  STATE  IS HEREBY AUTHORIZED TO REQUIRE MINORS WHO ARE
    5  FIVE YEARS OF AGE ON OR BEFORE DECEMBER  FIRST  TO  ATTEND  KINDERGARTEN
    6  INSTRUCTION  FROM  THE FIRST DAY THAT THE APPROPRIATE PUBLIC SCHOOLS ARE
    7  IN SESSION IN SEPTEMBER OF SUCH SCHOOL YEAR, AND  A  MINOR  WHO  BECOMES
    8  FIVE  YEARS  OF AGE AFTER THE FIRST OF DECEMBER IN ANY SCHOOL YEAR SHALL
    9  BE REQUIRED TO ATTEND KINDERGARTEN FROM THE FIRST DAY OF SESSION IN  THE
   10  FOLLOWING  SEPTEMBER.  HOWEVER  THE PROVISIONS OF THIS SUBDIVISION SHALL
   11  NOT APPLY TO STUDENTS ENROLLED IN NON-PUBLIC SCHOOLS OR IN HOME INSTRUC-
   12  TION.
   13    S 2. This act shall take effect immediately.
