CLARK -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to attendance of minors THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 3205 of the education law is amended by adding a 2 new subdivision 4 to read as follows: 3 4. COMMENCING DECEMBER FIRST, TWO THOUSAND FIFTEEN, EACH SCHOOL 4 DISTRICT OF THE STATE IS HEREBY AUTHORIZED TO REQUIRE MINORS WHO ARE 5 FIVE YEARS OF AGE ON OR BEFORE DECEMBER FIRST TO ATTEND KINDERGARTEN 6 INSTRUCTION FROM THE FIRST DAY THAT THE APPROPRIATE PUBLIC SCHOOLS ARE 7 IN SESSION IN SEPTEMBER OF SUCH SCHOOL YEAR, AND A MINOR WHO BECOMES 8 FIVE YEARS OF AGE AFTER THE FIRST OF DECEMBER IN ANY SCHOOL YEAR SHALL 9 BE REQUIRED TO ATTEND KINDERGARTEN FROM THE FIRST DAY OF SESSION IN THE 10 FOLLOWING SEPTEMBER. HOWEVER THE PROVISIONS OF THIS SUBDIVISION SHALL 11 NOT APPLY TO STUDENTS ENROLLED IN NON-PUBLIC SCHOOLS OR IN HOME INSTRUC- 12 TION. 13 S 2. This act shall take effect immediately.
