          Committee on Governmental Operations

        AN ACT to amend the executive law, in relation to requiring the  disclo-
          sure  of disabled tenants' rights to reasonable accommodations; and to
          repeal certain provisions of such law related thereto

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subdivision  2-b  of section 296 of the executive law, as
     2  added by a chapter of the laws  of  2020  amending  the  executive  law,
     3  relating  to  requiring  the  disclosure  of disabled tenants' rights to
     4  reasonable accommodations, as  proposed  in  legislative  bills  numbers
     5  S.6220-A and A.8149-A, is REPEALED.
     6    § 2. Subdivision 18-a of section 296 of the executive law, as added by
     7  a  chapter  of  the laws of 2020 amending the executive law, relating to
     8  requiring the disclosure  of  disabled  tenants'  rights  to  reasonable
     9  accommodations,  as  proposed  in legislative bills numbers S.6220-A and
    10  A.8149-A, is REPEALED.
    11    § 3. The executive law is amended by adding a  new  section  170-d  to
    12  read as follows:
    13    § 170-d. Disclosure of disabled tenants' rights. The division of human
    14  rights  shall  promulgate  regulations  requiring every housing provider
    15  under subdivisions two-a and five of section two hundred  ninety-six  of
    16  this  chapter, to provide notice to all tenants and prospective tenants,
    17  in writing, within thirty days of the effective date of  their  tenancy,
    18  or  thirty  days  from  the  effective  date of this section for current
    19  tenants, of their rights to request reasonable modifications and  accom-
    20  modations pursuant to subparagraphs one, two and three of paragraph d of
    21  subdivision  two-a of section two hundred ninety-six of this chapter and
    22  subdivision eighteen of section two hundred ninety-six of this chapter.
    23    § 4. This act shall take effect on the  same  date  and  in  the  same
    24  manner  as  a  chapter  of  the laws of 2020 amending the executive law,
    25  relating to requiring the disclosure  of  disabled  tenants'  rights  to
    26  reasonable  accommodations,  as  proposed  in  legislative bills numbers
    27  S.6220-A and A.8149-A, takes effect.
