STATE OF NEW YORK ________________________________________________________________________ 1764 2021-2022 Regular Sessions IN ASSEMBLY January 11, 2021 ___________ Introduced by M. of A. PRETLOW -- read once and referred to the Commit- tee on Economic Development AN ACT to amend the general business law, in relation to requiring oil companies to clean up spillage occurring during a delivery The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The general business law is amended by adding a new section 2 309 to read as follows: 3 § 309. Oil delivery spillage. Any spillage occurring in the course of 4 oil delivery shall be cleaned up by the oil delivery company within 5 twenty-four hours. If the spill affects soil the clean up shall include 6 replacing the affected soil with new soil. Violation of this section 7 shall result in a fine of five hundred dollars for the first offense and 8 one thousand dollars for each additional offense, not to exceed ten 9 thousand dollars payable by the oil delivery company. 10 § 2.
