          Committee on Health

        AN ACT to amend the public  health  law,  in  relation  to  funding  for
          providers  who  engage  in  treatment  and  services  for  people with
          HIV/AIDS

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Paragraph  (e)  of  subdivision  1 of section 2776 of the
     2  public health law, as added by chapter 823  of  the  laws  of  1983,  is
     3  amended to read as follows:
     4    (e)  to  promote  the availability of supportive services for affected
     5  persons; provided, however, that request for  applications  for  funding
     6  administered  by  the  institute  shall not include minimum requirements
     7  inconsistent with the Federal  Health  Resource  and  Services  Adminis-
     8  tration  Guidance  for  the  administration  of  the Ryan White HIV/AIDS
     9  Program.  Furthermore, the institute shall not require funds be adminis-
    10  tered to clinics or hospitals licensed pursuant to article  twenty-eight
    11  of this chapter.
    12    § 2. This act shall take effect immediately.
