STATE OF NEW YORK ________________________________________________________________________ 1580 2017-2018 Regular Sessions IN ASSEMBLY January 12, 2017 ___________ Introduced by M. of A. MOSLEY -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to authorizing the issuance of license plates bearing the words "Cure Childhood Cancer" and to amend the state finance law, in relation to establish- ing the cure childhood cancer trust fund The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 404-y to read as follows: 3 § 404-y. Distinctive "Cure Childhood Cancer" plates. 1. Any person 4 residing in this state shall upon request be issued a distinctive plate 5 bearing the words "Cure Childhood Cancer". Application for such plates 6 shall be filed with the commissioner in such form and detail as the 7 commissioner shall prescribe. 8 2. Any distinctive plate issued pursuant to this section shall be 9 issued in the same manner as other number plates upon the payment of the 10 regular registration fee prescribed by section four hundred one of this 11 article provided, however, that an additional annual service charge of 12 fifty dollars shall be charged for such plate. Such annual service 13 charge shall be deposited pursuant to the provisions of section four 14 hundred four-oo of this article to the credit of the department of motor 15 vehicles distinctive plate development fund established by section nine- 16 ty-five-g of the state finance law, and shall be used for the 17 production, design, advertising and marketing of distinctive license 18 plates pursuant to such section ninety-five-g; provided, however, that 19 annual service charges collected in excess of four thousand dollars 20 shall be deposited to the credit of the "cure childhood cancer trust 21 fund" established pursuant to section ninety-nine-aa of the state 22 finance law and shall be used for childhood cancer research and educa- 23 tion projects approved by the commissioner of health or to provide EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD04031-01-7A. 1580 2 1 grants to state university of New York health science centers or univer- 2 sity hospitals for the purpose of researching and promoting a cure for 3 childhood cancer, pursuant to such section ninety-nine-aa. 4 § 2. The state finance law is amended by adding a new section 99-aa to 5 read as follows: 6 § 99-aa. Cure childhood cancer trust fund. 1. There is hereby estab- 7 lished in the joint custody of the commissioner of taxation and finance 8 and the comptroller, a special fund to be known as the "cure childhood 9 cancer trust fund". 10 2. Such fund shall consist of all revenues received pursuant to the 11 provisions of section four hundred four-y of the vehicle and traffic law 12 and all other moneys appropriated, credited or transferred thereto from 13 any other fund or source pursuant to law. Nothing contained in this 14 section shall prevent the state from receiving grants, gifts or bequests 15 for the purposes of the fund as defined in this section and depositing 16 them into the fund according to law. 17 3. Monies of the fund shall be expended for pediatric cancer care, 18 treatment and wellness to include, but not be limited to physical and 19 occupational therapy, art therapy, counseling, research grants and 20 educational projects. Such funds will be expended through a grant proc- 21 ess created by and on the recommendation of the commissioner of health 22 to integrative medical facilities, state of New York health centers, 23 university hospitals or community-based not-for-profit organizations 24 that operate childhood cancer awareness and support programs. 25 4. Monies shall be payable from the fund on vouchers recommended by 26 the commissioner of health, after audit and approval by the state comp- 27 troller and office of the attorney general. 28 5. To the extent practicable, the commissioner of health shall ensure 29 that all monies received during a fiscal year are expended prior to the 30 end of that fiscal year. 31 § 3. This act shall take effect on the one hundred eightieth day after 32 it shall have become a law; provided, however, that effective immediate- 33 ly, the addition, amendment and/or repeal of any rule or regulation 34 necessary for the implementation of this act on its effective date are 35 authorized and directed to be made and completed on or before such 36 effective date.
