       AN ACT to amend the public service law, in relation to nondiscrimination
         on pay service telephone rates
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 91 of the public service law is amended by adding a
    2  new subdivision 7 to read as follows:
    3    7. THE RATES CHARGED BY A LOCAL  EXCHANGE  TELEPHONE  COMPANY  SERVING
    4  OVER  THREE  HUNDRED FIFTY THOUSAND ACCESS LINES IN THIS STATE, FOR EACH
    5  UNDERLYING SERVICE OR FACILITY, INCLUDING  BUT  NOT  LIMITED  TO  ACCESS
    6  LINES, USAGE, FEATURES, FUNCTIONS, AND INSTALLATION, PROVIDED FOR RESALE
    7  TO  AN  OWNER OR OPERATOR OF PUBLIC PAY TELEPHONES, FOR USE IN PROVIDING
    8  PUBLIC PAY TELEPHONE SERVICE, SHALL BE EQUAL TO  THE  RATES  CHARGED  BY
    9  SAID  LOCAL  EXCHANGE  TELEPHONE COMPANY TO A TELECOMMUNICATIONS CARRIER
   10  FOR THE UNBUNDLED NETWORK ELEMENTS WHICH,  IN  THE  AGGREGATE,  ARE  THE
   11  COMPONENTS OF EACH SUCH UNDERLYING SERVICE AND FACILITY PROVIDED TO SUCH
   12  OWNER OR OPERATOR.
   13    S  2.  This  act  shall take effect on the sixtieth day after it shall
   14  have become a law.
