        AN  ACT  to  amend the education law, in relation to aid for coordinated
          collection development grants for public  and  non-profit  independent
          colleges and universities
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Legislative findings. The formula directing  state  aid  to
     2  public and private academic and research libraries has not been adjusted
     3  since 1984. During that time prices of published academic materials have
     4  outpaced inflation, often rising at a rate of more than three times that
     5  of  inflation. The state provides aid to these libraries for the purpose
     6  of improving access and resources in a coordinated manner. This  program
     7  needs  an adjustment in its formula if the goals of quality and accessi-
     8  ble scholarship are to be maintained.  Therefore,  it  is  in  the  best
     9  interests of the state, its citizens and long-term academic and economic
    10  prospects  to support modernization of the coordinated collection devel-
    11  opment aid (CCDA) formula.
    12    § 2. Subdivision 5 of section 273 of the education law, as amended  by
    13  section  3  of  part  O of chapter 57 of the laws of 2005, is amended to
    14  read as follows:
    15    5. Coordinated collection development program for public and nonprofit
    16  independent colleges and universities.
    17    a. Libraries of public and nonprofit independent colleges and  univer-
    18  sities  are  entitled  to  receive  annual  funding  for  a  coordinated
    19  collection development grant if they meet the following conditions:
    20    (1) Membership in a reference and research library resources system,
    21    (2) Their resources are made available to  the  public,  through  full
    22  participation  in  the  interlibrary  loan  and  other  resource sharing

     1  programs of the reference and research library resources system of which
     2  they are members, and
     3    (3) They meet the requirements set forth in regulations adopted by the
     4  commissioner including but not confined to
     5    (a) maintenance of effort,
     6    (b)  relationships  between  reference  and research library resources
     7  systems' programs and the regional higher education master plan,
     8    (c) submission of interlibrary loan statistics, and such other reports
     9  as may be required by the commissioner.
    10    b. Public and nonprofit independent  colleges  and  universities  with
    11  libraries which meet the criteria of paragraph a of this subdivision are
    12  eligible for annual grants as follows:
    13    (1)  [Four  thousand  four  hundred dollars for each institution] Five
    14  thousand five hundred dollars for each institution in  fiscal  year  two
    15  thousand  nineteen--two  thousand  twenty,  six  thousand  eight hundred
    16  seventy-five dollars for each institution in fiscal  year  two  thousand
    17  twenty--two  thousand twenty-one, eight thousand six hundred dollars for
    18  each institution in fiscal year two  thousand  twenty-one--two  thousand
    19  twenty-two, ten thousand dollars for each institution in fiscal year two
    20  thousand twenty-two--two thousand twenty-three, and
    21    (2)  One  dollar  and four cents for each full-time equivalent student
    22  enrolled in each qualifying institution, in the academic year  completed
    23  prior  to  [the]  state  fiscal year two thousand nineteen--two thousand
    24  twenty.  Thereafter the rate shall be set at the level of  the  previous
    25  fiscal  year  indexed to any positive growth in the Consumer Price Index
    26  as set by the United States Bureau of Labor Statistics. For purposes  of
    27  this section, a full-time equivalent shall be calculated as follows:
    28    (i)  one full-time undergraduate student shall be considered one full-
    29  time equivalent student;
    30    (ii) one part-time undergraduate student shall be considered one-third
    31  of a full-time equivalent student;
    32    (iii) one part-time graduate student shall be considered one full-time
    33  equivalent student; and
    34    (iv) one full-time graduate student shall be considered one  and  one-
    35  half of a full-time equivalent student.
    36    c.  Funds for the support of this program shall be appropriated to the
    37  department, except that funds for the state-operated institutions of the
    38  state university of New York and the senior colleges of the city univer-
    39  sity of New York, shall be appropriated to the state university  of  New
    40  York  out of any moneys in the state treasury in the general fund to the
    41  credit of the state purposes fund not otherwise appropriated, and  funds
    42  shall  be  appropriated  to  the  city university of New York out of any
    43  moneys in the state treasury in the general fund to the  credit  of  the
    44  local  assistance  fund not otherwise appropriated, and shall be subject
    45  to the same distribution formula as provided  in  paragraph  b  of  this
    46  subdivision.
    47    § 3. This act shall take effect immediately.
