         on Education
       AN  ACT to amend the education law, in relation to requiring the commis-
         sioner of education to promulgate rules and regulations requiring that
         all students in grade five or below remain at their school unless they
         are under the supervision of authorized transportation,  a  parent  or
         guardian or another authorized person
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 305 of the education law is amended by adding a new
    2  subdivision 42 to read as follows:
    3    42. THE COMMISSIONER IS AUTHORIZED AND DIRECTED  TO  PROMULGATE  RULES
    4  AND REGULATIONS WHICH REQUIRE THAT ALL STUDENTS WHO ARE IN GRADE FIVE OR
    5  BELOW  AND  WHO ARE ATTENDING SCHOOL ON A PARTICULAR DAY SHALL REMAIN AT
    6  THEIR SCHOOL BUILDING UNLESS THEY ARE RELEASED UNDER THE SUPERVISION  OF
    7  AUTHORIZED  TRANSPORTATION,  A  PARENT OR GUARDIAN OR ANOTHER AUTHORIZED
    8  PERSON.
    9    S 2. This act shall take effect immediately.
