The civil service law is amended by adding a new section 2 85-c to read as follows: 3 S 85-C. ADDITIONAL CREDIT ALLOWED VOLUNTEER FIREFIGHTERS AND VOLUN- 4 TEER AMBULANCE WORKERS IN COMPETITIVE EXAMINATIONS; PREFERENCE IN 5 RETENTION UPON ABOLITION OF POSITIONS. 1. DEFINITIONS. AS USED IN THIS 6 SECTION: 7 (A) THE TERM "VOLUNTEER FIREFIGHTER" SHALL HAVE THE SAME MEANING AS 8 ASCRIBED TO SUCH TERM IN SECTION THREE OF THE VOLUNTEER FIREFIGHTERS' 9 BENEFIT LAW. 10 (B) THE TERM "VOLUNTEER AMBULANCE WORKER" SHALL HAVE THE SAME MEANING 11 AS ASCRIBED TO SUCH TERM IN SECTION THREE OF THE VOLUNTEER AMBULANCE 12 WORKERS' BENEFIT LAW. 13 2. ADDITIONAL CREDITS IN COMPETITIVE EXAMINATIONS FOR ORIGINAL 14 APPOINTMENT OR PROMOTION. (A) ON ALL ELIGIBLE LISTS RESULTING FROM 15 COMPETITIVE EXAMINATIONS, THE NAMES OF ELIGIBLES SHALL BE ENTERED IN THE 16 ORDER OF THEIR RESPECTIVE FINAL EARNED RATINGS ON EXAMINATION, WITH THE 17 NAME OF THE ELIGIBLE WITH THE HIGHEST FINAL EARNED RATING AT THE HEAD OF 18 SUCH LIST, PROVIDED, HOWEVER, THAT FOR THE PURPOSE OF DETERMINING FINAL 19 EARNED RATINGS, VOLUNTEER FIREFIGHTERS AND VOLUNTEER AMBULANCE WORKERS EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD03422-01-9 A. 1159 2 1 SHALL BE ENTITLED TO RECEIVE IN A COMPETITIVE EXAMINATION FOR ORIGINAL 2 APPOINTMENT AN ADDITIONAL FIVE POINTS. 3 (B) SUCH ADDITIONAL CREDIT SHALL BE ADDED TO THE FINAL EARNED RATING 4 OF SUCH VOLUNTEER FIREFIGHTER OR VOLUNTEER AMBULANCE WORKER AFTER HE OR 5 SHE HAS QUALIFIED IN THE COMPETITIVE EXAMINATION AND SHALL BE GRANTED 6 ONLY AT THE TIME OF ESTABLISHMENT OF THE RESULTING ELIGIBLE LIST. 7 3. APPLICATION FOR ADDITIONAL CREDIT; PROOF OF ELIGIBILITY; ESTAB- 8 LISHMENT OF ELIGIBLE LIST. ANY CANDIDATE, BELIEVING HIMSELF OR HERSELF 9 ENTITLED TO ADDITIONAL CREDIT IN A COMPETITIVE EXAMINATION AS PROVIDED 10 HEREIN, MAY MAKE APPLICATION FOR SUCH ADDITIONAL CREDIT AT ANY TIME 11 BETWEEN THE DATE OF HIS OR HER APPLICATION FOR EXAMINATION AND THE DATE 12 OF THE ESTABLISHMENT OF THE RESULTING ELIGIBLE LIST. SUCH CANDIDATES 13 SHALL BE ALLOWED A PERIOD OF NOT LESS THAN TWO MONTHS FROM THE DATE OF 14 THE FILING OF HIS OR HER APPLICATION FOR EXAMINATION IN WHICH TO ESTAB- 15 LISH BY APPROPRIATE DOCUMENTARY PROOF HIS OR HER ELIGIBILITY TO RECEIVE 16 ADDITIONAL CREDIT UNDER THIS SECTION. AT ANY TIME AFTER TWO MONTHS HAVE 17 ELAPSED SINCE THE FINAL DATE FOR FILING APPLICATIONS FOR A COMPETITIVE 18 EXAMINATION FOR ORIGINAL APPOINTMENT OR PROMOTION, THE ELIGIBLE LIST 19 RESULTING FROM SUCH EXAMINATION MAY BE ESTABLISHED, NOTWITHSTANDING THE 20 FACT THAT A VOLUNTEER FIREFIGHTER OR A VOLUNTEER AMBULANCE WORKER WHO 21 HAS APPLIED FOR ADDITIONAL CREDIT HAS FAILED TO ESTABLISH HIS OR HER 22 ELIGIBILITY TO RECEIVE SUCH ADDITIONAL CREDIT. A CANDIDATE MUST BE IN 23 GOOD STANDING AND SUCH EVIDENCE MUST BE CERTIFIED AND SUBMITTED AS 24 SUPPORTING DOCUMENTATION TO THE DEPARTMENT. A CANDIDATE WHO FAILS TO 25 ESTABLISH, BY APPROPRIATE DOCUMENTARY PROOF, HIS OR HER ELIGIBILITY TO 26 RECEIVE ADDITIONAL CREDIT BY THE TIME AN ELIGIBLE LIST IS ESTABLISHED 27 SHALL NOT THEREAFTER BE GRANTED ADDITIONAL CREDIT ON SUCH ELIGIBLE LIST. 28 4. USE OF ADDITIONAL CREDIT. (A) EXCEPT AS OTHERWISE PROVIDED IN 29 THIS SECTION, NO PERSON WHO HAS RECEIVED A PERMANENT ORIGINAL APPOINT- 30 MENT OR A PERMANENT PROMOTION IN THE CIVIL SERVICE OF THE STATE OR OF 31 ANY CITY OR CIVIL DIVISION THEREOF FROM AN ELIGIBLE LIST ON WHICH HE OR 32 SHE WAS ALLOWED THE ADDITIONAL CREDIT GRANTED BY THIS SECTION AS A 33 VOLUNTEER FIREFIGHTER OR A VOLUNTEER AMBULANCE WORKER SHALL THEREAFTER 34 BE ENTITLED TO ANY ADDITIONAL CREDIT UNDER THIS SECTION AS A VOLUNTEER 35 FIREFIGHTER OR A VOLUNTEER AMBULANCE WORKER. 36 (B) WHERE, AT THE TIME OF ESTABLISHMENT OF AN ELIGIBLE LIST, THE 37 POSITION OF A VOLUNTEER FIREFIGHTER OR A VOLUNTEER AMBULANCE WORKER ON 38 SUCH LIST HAS NOT BEEN AFFECTED BY THE ADDITION OF CREDITS GRANTED UNDER 39 THIS SECTION, THE APPOINTMENT OR PROMOTION OF SUCH VOLUNTEER FIREFIGHTER 40 OR SUCH VOLUNTEER AMBULANCE WORKER FROM SUCH ELIGIBLE LIST SHALL NOT BE 41 DEEMED TO HAVE BEEN MADE FROM AN ELIGIBLE LIST ON WHICH HE OR SHE WAS 42 ALLOWED THE ADDITIONAL CREDIT GRANTED BY THIS SECTION. 43 (C) IF, AT THE TIME OF APPOINTMENT FROM AN ELIGIBLE LIST, A VOLUNTEER 44 FIREFIGHTER OR A VOLUNTEER AMBULANCE WORKER IS IN THE SAME RELATIVE 45 STANDING AMONG THE ELIGIBLES WHO ARE WILLING TO ACCEPT APPOINTMENT AS IF 46 HE OR SHE HAD NOT BEEN GRANTED THE ADDITIONAL CREDITS PROVIDED BY THIS 47 SECTION, HIS OR HER APPOINTMENT FROM AMONG SUCH ELIGIBLES SHALL NOT BE 48 DEEMED TO HAVE BEEN MADE FROM AN ELIGIBLE LIST ON WHICH HE OR SHE WAS 49 ALLOWED SUCH ADDITIONAL CREDITS. 50 (D) WHERE A VOLUNTEER FIREFIGHTER OR A VOLUNTEER AMBULANCE WORKER HAS 51 BEEN ORIGINALLY APPOINTED OR PROMOTED FROM AN ELIGIBLE LIST ON WHICH HE 52 OR SHE WAS ALLOWED ADDITIONAL CREDIT, BUT SUCH APPOINTMENT OR PROMOTION 53 IS THEREAFTER TERMINATED EITHER AT THE END OF THE PROBATIONARY TERM OR 54 BY RESIGNATION AT OR BEFORE THE END OF THE PROBATIONARY TERM, HE OR SHE 55 SHALL NOT BE DEEMED TO HAVE BEEN APPOINTED OR PROMOTED, AS THE CASE MAY 56 BE, FROM AN ELIGIBLE LIST ON WHICH HE OR SHE WAS ALLOWED ADDITIONAL A. 1159 3 1 CREDIT, AND SUCH APPOINTMENT OR PROMOTION SHALL NOT AFFECT HIS OR HER 2 ELIGIBILITY FOR ADDITIONAL CREDIT IN OTHER EXAMINATIONS. 3 5. WITHDRAWAL OF APPLICATION; ELECTION TO RELINQUISH ADDITIONAL CRED- 4 IT. AN APPLICATION FOR ADDITIONAL CREDIT IN A COMPETITIVE EXAMINATION 5 UNDER THIS SECTION MAY BE WITHDRAWN BY THE APPLICANT AT ANY TIME PRIOR 6 TO THE ESTABLISHMENT OF THE RESULTING ELIGIBLE LIST. AT ANY TIME DURING 7 THE TERM OF EXISTENCE OF AN ELIGIBLE LIST RESULTING FROM A COMPETITIVE 8 EXAMINATION IN WHICH A VOLUNTEER FIREFIGHTER OR A VOLUNTEER AMBULANCE 9 WORKER HAS RECEIVED THE ADDITIONAL CREDIT GRANTED BY THIS SECTION, SUCH 10 VOLUNTEER FIREFIGHTER OR VOLUNTEER AMBULANCE WORKER MAY ELECT, PRIOR TO 11 PERMANENT ORIGINAL APPOINTMENT OR PERMANENT PROMOTION, TO RELINQUISH THE 12 ADDITIONAL CREDIT THERETOFORE GRANTED TO HIM OR HER AND ACCEPT THE LOWER 13 POSITION ON SUCH ELIGIBLE LIST TO WHICH HE OR SHE WOULD OTHERWISE HAVE 14 BEEN ENTITLED; PROVIDED, HOWEVER, THAT SUCH ELECTION SHALL THEREAFTER BE 15 IRREVOCABLE. SUCH ELECTION SHALL BE IN WRITING AND SIGNED BY THE VOLUN- 16 TEER FIREFIGHTER OR THE VOLUNTEER AMBULANCE WORKER, AND TRANSMITTED TO 17 THE DEPARTMENT OR THE APPROPRIATE MUNICIPAL CIVIL SERVICE COMMISSION. 18 6. ROSTER. THE DEPARTMENT AND EACH MUNICIPAL COMMISSION SHALL ESTAB- 19 LISH AND MAINTAIN IN ITS OFFICE A ROSTER OF ALL VOLUNTEER FIREFIGHTERS 20 AND VOLUNTEER AMBULANCE WORKERS APPOINTED OR PROMOTED AS A RESULT OF 21 ADDITIONAL CREDITS GRANTED BY THIS SECTION TO POSITIONS UNDER ITS JURIS- 22 DICTION. THE APPOINTMENT OR PROMOTION OF A VOLUNTEER FIREFIGHTER OR A 23 VOLUNTEER AMBULANCE WORKER AS A RESULT OF ADDITIONAL CREDITS SHALL BE 24 VOID IF SUCH VOLUNTEER FIREFIGHTER OR VOLUNTEER AMBULANCE WORKER, PRIOR 25 TO SUCH APPOINTMENT OR PROMOTION, HAD BEEN APPOINTED OR PROMOTED AS A 26 RESULT OF ADDITIONAL CREDITS GRANTED BY THIS SECTION. 27 S 2. This act shall take effect immediately.
