PAULIN, ZEBROWSKI, OTIS, HOOPER, RAIA, CROUCH, LALOR, SCHIMMINGER, SIMON -- read once and referred to the Committee on Transportation -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- again reported from said committee with amendments, ordered reprinted as amended and recommitted to said committee AN ACT to amend the vehicle and traffic law, in relation to the issuance of a distinctive license plate for veterans of the Iraq War and veter- ans of the Afghanistan War The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 404-y to read as follows: 3 § 404-y. Distinctive plates for veterans of the Iraq War and veterans 4 of the Afghanistan War. 1. Any veteran of the Iraq War or the Afghanis- 5 tan War residing in this state or the spouse of any such veteran shall, 6 upon request, be issued a license plate bearing the words "Veteran of 7 the Iraq War" or "Veteran of the Afghanistan War". If a distinctive 8 plate is issued to a veteran pursuant to this section, such a distinc- 9 tive plate shall not be issued to the spouse of such veteran. Applica- 10 tion for said license plate shall be filed with the commissioner in such 11 form and detail as the commissioner shall prescribe. 12 2. The distinctive plates authorized in subdivision one of this 13 section shall be issued upon proof, satisfactory to the commissioner, 14 that the applicant or the spouse of the applicant is a veteran of the 15 Iraq War or the Afghanistan War. 16 3. For the purposes of this section, the following terms shall have 17 the following meanings: 18 (a) "Veteran of the Iraq War" shall mean a person who is a resident of 19 this state, who served in the armed forces of the United States in the 20 hostilities that occurred in Iraq from the sixteenth day of October, two EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD04885-07-7A. 1112--B 2 1 thousand two to the end of such hostilities who was discharged therefrom 2 under other than dishonorable conditions; and 3 (b) "Veteran of the Afghanistan War" shall mean a person who is a 4 resident of this state, who served in the armed forces of the United 5 States in the hostilities that occurred in Afghanistan from the seventh 6 day of October, two thousand one to the end of such hostilities who was 7 discharged therefrom under other than dishonorable conditions. 8 4. A distinctive plate issued pursuant to this section shall be issued 9 in the same manner as other number plates upon payment of the regular 10 registration fee prescribed by section four hundred one of this article 11 provided, however, that an additional one time service charge of ten 12 dollars shall be charged for such plate. 13 § 2. 1. A distinctive plate established pursuant to section 404-y of 14 the vehicle and traffic law as added by section one of this act shall 15 only be designed, produced and issued upon the delivery to the depart- 16 ment of motor vehicles of a surety bond in the amount of six thousand 17 dollars, which shall be executed by a surety company authorized by the 18 department of financial services to transact business in this state. 19 Provided, however, that if the commissioner of motor vehicles shall have 20 received prior to plate design, production and issuance at least two 21 hundred orders for such distinctive plate together with the additional 22 one-time service charge applicable to each such order, which shall be 23 non-refundable, no such surety bond shall be required. All service 24 charges collected pursuant to this section shall be deposited pursuant 25 to the provisions of section 404-oo of the vehicle and traffic law to 26 the credit of the department of motor vehicles distinctive plate devel- 27 opment fund established by section 95-g of the state finance law and 28 shall be used for the design, production, advertising and distribution 29 of distinctive license plates in accordance with such section 95-g. 30 2. If, upon the expiration of two years following the date upon which 31 distinctive plates in the series are first available for sale two 32 hundred or more sets of such plates are sold, a bond delivered pursuant 33 to this section shall be discontinued. If fewer than two hundred sets of 34 such plates are sold by such time, the department of motor vehicles 35 shall be entitled to recover against the bond in an amount proportionate 36 to such shortfall. 37 § 3. This act shall take effect immediately; provided, however, that 38 section one of this act shall take effect on the one hundred eightieth 39 day after it shall have become a law; and provided further, that effec- 40 tive immediately, the addition, amendment and/or repeal of any rule or 41 regulation necessary for the implementation of this act on its effective 42 date are authorized and directed to be made and completed on or before 43 such effective date.
