        AN ACT to amend the  social  services  law,  in  relation  to  exempting
          certain  income  and resources provided to persons enrolled in certain
          pilot programs with direct cash transfers in  determining  eligibility
          for public assistance benefits

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subparagraph (x) of  paragraph  (a)  of  subdivision  8  of
     2  section  131-a  of the social services law, as added by a chapter of the
     3  laws of 2022 amending the social  services  law  relating  to  exempting
     4  certain  income  and  resources  provided to persons enrolled in certain
     5  pilot programs with direct cash transfers in determining eligibility for
     6  public assistance benefits, as proposed in legislative bills numbers  S.
     7  5759-B and A.  6709-B, is amended to read as follows.
     8    [(x)] (xi) Any financial assistance received by individuals as part of
     9  their  participation  in  a  pilot  program that has developed a plan to
    10  study and evaluate the impact and potential benefits    of  direct  cash
    11  transfers.    Such  exemption  and disregard shall be applicable for the
    12  length of time the individual participates in the program, but not long-
    13  er than sixty  months.  [The  commissioner  shall  seek  federal  waiver
    14  authority to disregard income for the direct cash transfer pilot program
    15  for the purpose of the supplemental nutrition assistance program.]
    16    §  2.  Section  36-a of the social services law is amended by adding a
    17  new subdivision 4 to read as follows:
    18    4. The commissioner shall seek any federal waiver or waivers from  the
    19  United States department of agriculture that may be necessary to exclude
    20  income  provided  to  an  individual as part of their participation in a
    21  pilot program authorized under section one hundred thirty-one-a of  this
    22  chapter for supplemental nutrition assistance program eligibility deter-
    23  mination purposes.

     1    §  3.  This  act  shall  take  effect on the same date and in the same
     2  manner as a chapter of the laws of 2022 amending the social services law
     3  relating to exempting certain income and resources provided  to  persons
     4  enrolled  in certain pilot programs with direct cash transfers in deter-
     5  mining eligibility for public assistance benefits, as proposed in legis-
     6  lative bills numbers S. 5759-B and A. 6709-B, takes effect.
