GLICK -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to the licensing of the profession of acupuncture THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 8 of section 8216 of the education law, as 2 added by chapter 504 of the laws of 2014, is amended to read as follows: 3 (8) Any person who is licensed AND IN GOOD STANDING to practice 4 acupuncture in another state or country may practice acupuncture in this 5 state without a license solely for the purpose of conducting clinical 6 training, practice demonstrations or clinical research that is within 7 the practice of acupuncture in connection with a program of basic clin- 8 ical education, graduate education, or post-graduate education in an 9 approved school of acupuncture or in its affiliated clinical facility or 10 health care agency, or before a group of licensed acupuncturists who are 11 members of a professional society. ANY PERSON PRACTICING ACUPUNCTURE IN 12 NEW YORK STATE PURSUANT TO THIS SUBDIVISION SHALL BE SUBJECT TO THE 13 PERSONAL AND SUBJECT MATTER JURISDICTION AND DISCIPLINARY AND REGULATORY 14 AUTHORITY OF THE BOARD OF REGENTS AS IF HE OR SHE IS A LICENSEE AND AS 15 IF THE EXEMPTION PURSUANT TO THIS SUBDIVISION IS A LICENSE. SUCH INDI- 16 VIDUAL SHALL COMPLY WITH THE PROVISIONS OF THIS ARTICLE, THE RULES OF 17 THE BOARD OF REGENTS, AND THE REGULATIONS OF THE COMMISSIONER, RELATING 18 TO PROFESSIONAL MISCONDUCT, DISCIPLINARY PROCEEDINGS AND PENALTIES FOR 19 PROFESSIONAL MISCONDUCT. 20 S 2. This act shall take effect immediately and shall be deemed to 21 have been in full force and effect on the same date as chapter 504 of 22 the laws of 2014, took effect.
