STATE OF NEW YORK ________________________________________________________________________ 707 2019-2020 Regular Sessions IN ASSEMBLY (Prefiled) January 9, 2019 ___________ Introduced by M. of A. BRONSON -- read once and referred to the Commit- tee on Insurance AN ACT to amend the insurance law, in relation to requiring medical insurance carriers to provide certain coverage for service animals The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subsection (i) of section 3216 of the insurance law is 2 amended by adding a new paragraph 35 to read as follows: 3 (35) Every policy which provides medical, major medical, or similar 4 comprehensive-type coverage must provide coverage for the acquisition, 5 training, certification and veterinary care of a service animal, as 6 defined in subdivision one of section 242.00 of the penal law, when such 7 animal is deemed medically necessary by a licensed physician. 8 § 2. Subsection (l) of section 3221 of the insurance law is amended by 9 adding a new paragraph 21 to read as follows: 10 (21) Every policy which provides medical, major medical, or similar 11 comprehensive-type coverage must provide coverage for the acquisition, 12 training, certification and veterinary care of a service animal, as 13 defined in subdivision one of section 242.00 of the penal law, when such 14 animal is deemed medically necessary by a licensed physician. 15 § 3. Section 4303 of the insurance law is amended by adding a new 16 subsection (ss) to read as follows: 17 (ss) Every contract issued by a hospital services corporation or a 18 health services corporation which provides medical, major medical, or 19 similar comprehensive-type coverage must provide coverage for the acqui- 20 sition, training, certification and veterinary care of a service animal, 21 as defined in subdivision one of section 242.00 of the penal law, when 22 such animal is deemed medically necessary by a licensed physician. 23 § 4.
