        AN ACT to amend the executive law, in relation to the annual  report  of
          the division of criminal justice services

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivisions 4-c and 12 of section  837  of  the  executive
     2  law,  subdivision  4-c  as  added by chapter 107 of the laws of 2000 and
     3  subdivision 12 as added by chapter 399 of the laws of 1972 and as renum-
     4  bered by chapter 603 of the  laws  of  1973,  are  amended  to  read  as
     5  follows:
     6    4-c. In cooperation with the chief administrator of the courts as well
     7  as  any  other public or private agency, including law enforcement agen-
     8  cies, collect and analyze statistical and all other information and data
     9  with respect to (a) the number of hate crimes reported  to  or  investi-
    10  gated  by  the  division  of state police, and all other police or peace
    11  officers, (b) the religion, race, ethnicity, age, sex,  and  the  sexual
    12  orientation and gender identity of the victim or victims of such crimes,
    13  (c)  the  number  of persons arrested for the commission of such crimes,
    14  (d) the offense for which the person was arrested, (e) the county within
    15  which the arrest was made and the accusatory instrument filed,  (f)  the
    16  disposition  of  the  accusatory  instrument  filed,  including, but not
    17  limited to, as the case may be, dismissal,  acquittal,  the  offense  to
    18  which the defendant pled guilty, the offense the defendant was convicted
    19  of after trial, and the sentence imposed, (g) when possible, information
    20  on  defendants  who  are  repeat offenders of hate crimes, including the
    21  number of such defendants, the offense to which the defendant pled guil-
    22  ty or was convicted of after trial and  information  on  the  victim  or
    23  victims of the defendant's crimes including the religion, race, ethnici-
    24  ty,  age,  sex,  and  the  sexual orientation and gender identity of the

     1  victim or victims, and (h) when possible,  the  number  of  crimes  that
     2  include  damage to the property of a religious institution. The division
     3  shall include the statistics and  other  information  required  by  this
     4  subdivision  in the annual report submitted to the governor and legisla-
     5  ture pursuant to subdivision twelve of this section.
     6    12. Make an annual report no later than March first of  each  year  to
     7  the  governor  and  legislature concerning its work during the preceding
     8  year, and such further interim reports to the governor, or to the gover-
     9  nor and legislature, as it shall deem advisable, or as shall be required
    10  by the governor;
    11    § 2. This act shall take effect immediately.
