        AN ACT to amend the public health law, in relation  to  requiring  camps
          and youth sports programs to establish an automated external defibril-
          lator implementation plan

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The public health law is amended by adding  a  new  section
     2  3000-f to read as follows:
     3    §  3000-f.  Automated  external  defibrillator; camps and youth sports
     4  programs. 1. Definitions.  As used in this section, unless  the  context
     5  clearly requires otherwise, the following terms have the following mean-
     6  ings:
     7    (a)   "Automated  external  defibrillator"  means  a  medical  device,
     8  approved by the United States food and drug administration, that: (i) is
     9  capable of recognizing the presence or absence in a patient of ventricu-
    10  lar fibrillation and rapid ventricular tachycardia; (ii) is  capable  of
    11  determining, without intervention by an operator, whether defibrillation
    12  should  be performed on a patient; (iii) upon determining that defibril-
    13  lation should be performed, automatically charges and requests  delivery
    14  of  an  electrical  impulse  to  a  patient's heart; and (iv) then, upon
    15  action by an operator, delivers an appropriate electrical impulse  to  a
    16  patient's heart to perform defibrillation.
    17    (b)  "Training  course" means a course approved by a nationally-recog-
    18  nized organization or the state emergency medical  services  council  in
    19  the operation of automated external defibrillators.

     1    (c) "Nationally-recognized organization" means a national organization
     2  approved  by the department for the purpose of training people in use of
     3  an automated external defibrillator.
     4    (d)  "Camp"  means  a  children's  overnight camp, summer day camp, or
     5  traveling summer day camp as such terms are defined in section  thirteen
     6  hundred ninety-two of this chapter.
     7    (e)  "Youth  sports  program"  means  any league or recreation program
     8  organized to provide group athletic activity to individuals under seven-
     9  teen years old or programs providing athletic activity for  high  school
    10  students  regardless  of  the  age of the participants of such programs.
    11  Public school athletic programs subject to the requirements  of  section
    12  nine  hundred seventeen of the education law shall not be subject to the
    13  requirements of this section.
    14    2. Within one hundred eighty  days  of  the  effective  date  of  this
    15  section,  a  camp  or youth sports program shall establish and submit to
    16  the department of health an automated external defibrillator implementa-
    17  tion plan describing how the camp or program will:
    18    (a) make available an automated external defibrillator at every  camp,
    19  game and practice; and
    20    (b)  ensure  that  there  is  at least one employee, volunteer, coach,
    21  umpire or other qualified adult who is present at each such  camp,  game
    22  and practice who has successfully completed a training course within the
    23  preceding  twenty-four  months of each such camp session, game and prac-
    24  tice.
    25    (c) Each camp and youth sports program shall  include  in  their  plan
    26  details  for  maintaining records that such camp or youth sports program
    27  possesses a sufficient number of automated  external  defibrillators  to
    28  meet the requirements of paragraphs (a) and (b) of this subdivision.
    29    (d)  Implementation  plans  shall  include  an equipment checklist and
    30  cardiac emergency protocol for when cardiac emergency incidents occur.
    31    3. Implementation of automated external defibrillator plans  shall  be
    32  done  in  accordance  with  the  requirements and protections of section
    33  3000-b of this article.
    34    § 2. This act shall take effect immediately.
