STATE OF NEW YORK ________________________________________________________________________ 222 2021-2022 Regular Sessions IN ASSEMBLY (Prefiled) January 6, 2021 ___________ Introduced by M. of A. MAGNARELLI -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to extending the term of existence of the city of Syracuse parking authority The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 1475-c of the public authorities 2 law, as added by chapter 477 of the laws of 2003, is amended to read as 3 follows: 4 1. A board to be known as "city of Syracuse parking authority" is 5 hereby created. Such board shall be a body corporate, constituting a 6 public benefit corporation, and its existence shall commence upon the 7 appointment of the members as provided in this section. It shall consist 8 of a chair and four other members, who shall be appointed by the mayor 9 of the city. Of the members first appointed, one shall be appointed for 10 a period of one year, one for a period of two years, one for a period of 11 three years, one for a period of four years, and one for a period of 12 five years. At the expiration of such terms, the terms of office of 13 their successors shall be five years. Each member shall continue to 14 serve until the appointment and qualification of his or her successor. 15 Vacancies in such board occurring otherwise than by the expiration of 16 term shall be filled for the unexpired term. The members of the board 17 shall choose from their number a vice chair and may choose a secretary 18 and treasurer who need not be members. The mayor may remove any member 19 of the board for neglect of duty or misconduct in office, giving such 20 member a copy of the charges against him or her and an opportunity of 21 being heard in person, or by counsel, in his or her defense upon not 22 less than ten days' notice. The members of the board shall be entitled 23 to no compensation for their services but shall be entitled to 24 reimbursement for their actual and necessary expenses incurred in the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The powers of the authority shall 2 be vested in and exercised by a majority of the members of the board. 3 Such board may delegate to one or more of its members or to its offi- 4 cers, agents and employees such powers and duties as it may deem proper. 5 Such board and its corporate existence shall continue only for a period 6 of [fifteen] thirty-two years, and thereafter until all its liabilities 7 have been met and its bonds have been paid in full or such liabilities 8 or bonds have otherwise been discharged. Upon its ceasing to exist, all 9 its rights and properties shall pass to the city. 10 § 2. This act shall take effect immediately.
